Medan District Court Judge Sentences Defendant Of Fresh Fruit Fraud Imports 2 Years 8 Months In Prison

The panel of judges at the Medan District Court, North Sumatra, sentenced Kevin Tanujaya (23) to 2 years and 8 months in prison, a defendant in the sale and purchase of imported fresh fruit worth Rp3.81 billion.

"Sentenced the defendant Kevin Tanujaya to imprisonment for two years and eight months in prison," said Chief Judge M. Nazir as quoted by ANTARA, Wednesday, July 24.

The judge stated that the defendant was proven to have violated Article 378 of the Criminal Code as the primary indictment.

"The defendant is believed to have committed an act with the intention of benefiting himself or others by fighting their rights, either by reason and trickery or by making lies," said Nazir.

The thing that aggravated the defendant's actions was that CV Grinyuni Fruit suffered a loss of Rp3.81 billion.

"Meanwhile, mitigating factors, the defendant was polite during the trial and had never been convicted," explained Judge Nazir.

The verdict is lighter than the demands of the Public Prosecutor (JPU) of the North Sumatra Prosecutor's Office, Haslinda Hasan, who at the previous trial charged the defendant with imprisonment for four years.

Responding to the decision, both the defendant Kevin Tanujayamaupun, the Public Prosecutor of the North Sumatra Prosecutor's Office, Haslinda Hasan, stated that he accepted.

In his indictment, Public Prosecutor Haslinda Hasan said this case occurred in April 2022 when the defendant as the owner of the Panam Indah Fruit Store in Pekanbaru City worked together to buy fresh imported fruit with CV Grinyuni Fruit in Medan City.

Then the defendant ordered fresh fruit imported by CV Grinyuni Fruit with payment made no later than two weeks after the fruit arrived at the defendant's shop in Pekanbaru City.

Furthermore, the defendant proposed the names of other people, totaling six people, to order the fresh imported fruit with the excuse that it would be easier to collect from customers.

The defendant promised that all purchase invoices using the names of the six people were his responsibility.

"However, the defendant did not keep his promise, resulting in CV Grinyuni Fruit losing Rp3.81 billion," concluded Haslinda.
