Lawsuit On The Age Limit For Presidential And Vice Presidential Candidates Rejected By The Constitutional Court, Garuda Legowo Party

JAKARTA - The Garuda Party respects the decision of the Constitutional Court (MK) to reject the request for a judicial review of Article 169 letter (q) of Law Number 7 of 2017 concerning General Elections (Pemilu) regarding the age limit for presidential and vice presidential candidates.

Secretary General (Sekjen) of the Garuda Party, Yohananna Murtika, has agreed to reject the judicial review of the Election Law. According to him, it is the full authority of the Constitutional Court.

"For his decision, we return it to the Constitutional Court as the highest legal institution in the country. For us, it is the authority of the Constitutional Court. The Garuda Party has expressed its wish through our attorney," said Yohanna in her statement, Monday, October 16, which was confiscated by Antara.

According to Yohananna, the Garuda Party has tried to apply for the judicial review.

Monday, October 16 at noon, the Constitutional Court rejected the application for judicial review of Article 169 letter (q) of the Election Law regarding the age limit requested by the Garuda Party.

In Case Number 51/PUU-XXI/2023, with Garuda Party Chairperson Ahmad Ridha Sabana and Garuda Party DPP Secretary General Yohananna Murtika, the applicant puts the phrase on the article being tested for material to be changed to a minimum age of 40 years or experienced as regional head or deputy regional head.

Applicants for judicial review of the Election Law regarding the age limit for presidential and vice presidential candidates consist of a number of parties, ranging from politicians and political parties, lawyers, regional heads, to students.

Apart from the Garuda Party, the Indonesian Solidarity Party (PSI) is also suing a similar article, which in its petitum asks for the age limit for presidential and vice presidential candidates to be changed to 35 years.

Based on the schedule set by the General Elections Commission (KPU), registration for the presidential and vice presidential candidate pairs will be on October 19-25, 2023.
