Kominfo Is Investigating The Preparation Of AI Regulations

JAKARTA - On December 19, 2023, the Ministry of Communication and Information Technology has released the Circular Letter of the Minister of Communication and Information Number 9 of 2023 concerning Artificial Intelligence Ethics.

With this circular, the Deputy Minister of Communication and Information Nezar Patria hopes to encourage the use of potential and create a safe and empowering digital architecture intelligence (AI) ecosystem.

"Many have asked Kominfo, what are the benefits of a circular letter? Indeed, this is a level that we call soft regulation, maybe it can be a guide and become a basis for higher arrangements later," said Nezar, quoted on Saturday, January 20.

But in the future, according to Nezar, the existence of this circular will complement existing regulations such as the ITE Law and also the Personal Data Protection Act.

"If there are cases related to violations of AI use, they can be referred to by the two laws plus other laws such as the Copyright Law and this circular," he added.

For further arrangements, Nezar admitted that currently the Ministry of Communication and Informatics is in the middle of initiating the preparation of ministerial regulations regarding AI Governance.

According to ELSAM Executive Director Wahyudi Djafar, the existence of SE Governance AI is an important lesson for Indonesia in responding well to the development of AI technology through appropriate stages.

"We try to use an ethical-based approach, then of course in the future we will discuss a lot in a policy manner, and the context of technology development by implementing a number of standards and ethics in AI development," he concluded.
