Judge Nawawi Pomolango becomes chairman of Banjarmasin court, Albertina Ho chairman of Banten court

JAKARTA - The Supreme Court (MA) reactivated former Chairman of the Corruption Eradication Commission (KPK) Nawawi Pomolango and Member of the KPK Supervisory Board (Dewas) Albertina Ho as judges in the general court environment.

Spokesperson for the Supreme Court, Yanto explained that Nawawi and Albertina's reactivation was based on the results of a meeting of the promotion team and the transfer of judges in the general court on December 20, 2024.

"By considering the position he has served as a KPK leader whose position can be equated with the echelon one position, the Supreme Court leadership decided that Nawawi Pomolango's brother was promoted as Chairman of the Banjarmasin High Court (PT), while Albertina ho was promoted as Deputy Chair (Waketu) of the Banten High Court (PT)," Yanto said at the MA Building, Jakarta, Thursday, January 2, which was confiscated by Antara.

He also explained that the reactivation of Nawawi and Albertina could be carried out, such as within the Prosecutor's Office or the Police, which could temporarily suspend membership if they entered the KPK, and reactivated when their term of office was over.

"Before serving at the KPK, Nawawi and Albertina had been temporarily dismissed from the positions of High Judge Denpasar, and Deputy Chairperson of the Kupang High Court, based on applicable regulations," he said.

Based on the provisions of the legislation, namely Article 31 paragraph (2) of Law Number 48 of 2009 concerning Judicial Power, Article 29 letter I of Law Number 30 of 2002 concerning the KPK which has been amended by Law Number 19 of 2019, and PP Number 36 of 2011, according to him, the person concerned must not hold concurrent positions and must be temporarily dismissed from the position of judge.

Therefore, he said, the Chairman of the Supreme Court at that time proposed the temporary dismissal of Nawawi and Albertina to the 7th President of the Republic of Indonesia Joko Widodo, and then temporarily dismissed since the end of December 2019 based on Presidential Decree (Keppres) Number 18/P of 2020.

Then, the re-activation was proposed by the Chairman of the Supreme Court in response to Presidential Decree No. 161/P of 2024 regarding the end of Nawawi and Albertina's term of office at the KPK.

"And based on Presidential Decree No. 162/P of 2024, the person concerned has been reactivated as a judge in the general court environment," he said.
