JAKARTA - The Food and Drug Supervisory Agency (BPOM) is following up on public reports related to illegal cosmetic sales by Kimberlybeauty88" and securing 152,744 cosmetics without distribution permits (TIE) with a total value estimated at more than IDR 2.2 billion.

The head of BPOM Taruna Ikrar said that the online shop owner had been making cosmetic sales businesses on two marketplace platforms for approximately one year with online sales of around 400 packages of shipments per day.

"Products sold in the form of illegal imported cosmetics with Lameila and SVMY brands. These products come from China with an import process through forwarder services," said Taruna as quoted by ANTARA, Monday, October 28.

He explained that the products confiscated were mostly facial makeup types that were suspected of containing dyes that were prohibited from being added to cosmetics, namely Red K-3 and Red K-10. Currently, he said, samples of the confiscated products have been taken for laboratory testing.

"The use of cosmetic products without distribution permits and/or containing dyes is strictly risky for health, because it is carcinogenic and can cause liver function disorders and liver cancer," said the cadet.

"Furthermore, we will call the owner and three employees to be examined as witnesses," he said.

Now, said the cadets, BPOM is conducting a further investigation process and the case files will be transferred to the DKI Jakarta Provincial High Prosecutor's Office.

The perpetrators of violations, he said, will be subject to provisions of Article 435 jo. Article 138 paragraph (2) of Law Number 17 of 2023 concerning Health carries a maximum imprisonment of 12 years or a maximum fine of IDR 5 billion.

With this latest finding, during 2024 the POM Center in Jakarta has followed up on prosecution in the form of five cases in the field of pharmaceutical preparation and one case in the food sector. Of the five cases, two of them were cases of illegal cosmetics with an economic value of evidence amounting to Rp5.8 billion.

Seeing the rampant circulation of illegal imported cosmetics, his party continues to actively collaborate with cross-sectors to try to eradicate this crime.

According to him, it is not only the people who are harmed by the circulation of this illegal imported product, but also the perpetrators of the local/national cosmetic business who run their business legally.

BPOM invites business actors to jointly eradicate this illegal imported product, one of which is by producing and marketing legal cosmetic products that are safe, useful, and quality.

The public as consumers is also advised to continue to educate themselves to be smart and empowered consumers in protecting themselves from medicinal products and food, including illegal cosmetics and/or containing harmful ingredients that are at risk of health.
