The Judicial Commission (KY) has imposed a permanent dismissal with the right of pension to three judges who handed over acquittal to the defendant Gregorius Ronald Tannur (GRT) in the murder case of Dini Sera Afrianti.
The three judges who were sanctioned were Erintuah Damanik, Mangapul, and Heru Hanindyo.
Member of the Indonesian Judicial Commission and Head of the Supervision of Judges and Investigations Joko Sasmito said the three were proven to have violated the Code of Code of Ethics for Guidelines and Judges' Behavior (KEPPH).
"The reported parties were proven to have violated the KEPPH, with a classification of the level of serious violations," said Joko when presenting the results of the KY plenary session during a meeting with Commission III of the DPR RI at the Parliament Complex, Jakarta, Antara, Monday, August 26.
Joko explained that the plenary session was held on Monday, just before KY attended a meeting with the DPR RI. The plenary meeting of the decision to dismiss the three judges was attended by all seven KY members.
Based on a number of findings, Joko explained that the judges read out legal facts and legal considerations related to different elements of the indictment between those read out at trial and those listed in the copy of case decision Number 454 / Pid.B / 2024 / PN.Sby.
Then the judges also read out legal considerations about the cause of death of the victim Dini Sera Afrianti which was different from the results of the visum et repertum, as well as the testimony of expert witness Dr. Renny Sumino from Dr. Soetomo Hospital.
In addition, according to him, the judges never considered, offended and/or gave an assessment of the evidence in the form of CCTV in the Lenmarc Mall basement parking area proposed by the public prosecutor in the verdict reading trial.
"Based on these considerations above, the Plenary Assembly is of the opinion that violations committed by the reported parties are included in the classification of serious violations, and the Indonesian Judicial Commission's Plenary Session Council has deliberated and agreed to impose severe sanctions," he said.
With the testimony of the witness, Deputy Chairman of Commission III of the Indonesian House of Representatives, Habiburokhman, said that the acquittal decision made by the Surabaya District Court to Ronald Tannur was quite phenomenal because it caught the public's attention.
He also considered that KY had also worked optimally on the existence of cases of violations of the code of ethics. However, he wanted KY to impose a permanent dismissal without pension rights.
"But that's okay sir, it's very maximal, thank you. I think friends (DPR members) will convey their appreciation to the Judicial Commission," said Habiburokhman.
