Jimly: If The PKPU According To The Constitutional Court's Decision Has Not Been Ratified On August 27, Kaesang Sah Maju Pilkada

JAKARTA - Former Chief Justice of the Constitutional Court (MK) Jimly Asshiddiqie emphasized that the Constitutional Court's decision will serve as a guideline for KPU Regulation (PKPU) for the 2024 Pilkada if it is set to a maximum before August 27, 2024.

If this is not realized, then the old PKPU will apply to follow the decision of the Supreme Court (MA).

"Before Per-KPU was determined in the context of following up on the Constitutional Court's decision. Per-KPU was the Per-KPU after the Supreme Court's decision," said the former Chairman of the Honorary Council of the Constitutional Court (MKMK) in his X account, Friday, August 23.

In the Supreme Court's decision at the old PKPU, the age requirements for regional head candidates are at least 30 years old starting from the inauguration of the elected candidate pair, not when registering with the KPU as in the Constitutional Court's decision.

Thus, he said, PSI Chairman Kaesang Pangarep could legally run in the 2024 Pilkada if the PKPU based on the Constitutional Court's decision was not ratified before Tuesday, August 27.

"If it arrives, August 27, 24, there is no new PerKPU, meaning that Kaesang fulfills the requirements. And if on the 27th he registers, he [Kaesang] can no longer be disallowed because the PerKPU is late," explained Jimly.

Previously, the Chairman of Commission II of the DPR from the Golkar faction, Ahmad Doli Kurnia, emphasized that the Constitutional Court's decision was the basic provision in the 2024 Pilkada.

This was said by Doli following the cancellation of the ratification of the revision of the Pilkada Law after a wave of elements of society took to the streets to express their rejection of the DPR's disobedience through Baleg to the Constitutional Court's decision.

"I think with the decision of the Constitutional Court, it means that we already know which laws and regulations [Pilkada 2024] are used," said Doli at the Parliament Complex, Senayan, Jakarta, Friday, August 23.

Doli admitted that Commission II of the DPR plans to ratify the PKPU based on the Constitutional Court's decision in a discussion meeting on Monday, August 26.

"Later, after and then based on KPU regulations, God willing, we will set a Monday," said Doli.
