Jadi, terkena (pidana) untuk kedua kali," kata Harimbawa di Mataram, Antara, Kamis, 2 Mei. The judge stated this by referring to the indictment of the public prosecutor regarding Article 15 Paragraph (1) letter b in conjunction with Article 11 Paragraph (2) of the Law of the Republic of Indonesia Number 11 of 1974 concerning Waters in conjunction with Article 64 Paragraph (1) of the Criminal Code. With the description of the verdict, the judge in the verdict sentenced WJM to 5 months in prison and a fine of Rp. 5 million, subsidiary to 3 months. The judge in the verdict also stated that WJM as a defendant did not have to serve a sentence, unless he returned to committing a crime in the period of carrying out the probationary sentence for 10 months. Furthermore, Harimbawa said that WJM's criminal act in 2018 had nothing to do with PT GNE. "So, since the 2018 decision, PT BAL has been on hiatus. Then, in 2022 it will be active again in cooperation with PT GNE, even though there is no permit for drilling, that's why we will act in 2023," he said. According to him, by repeating criminal acts, WJM has the potential to receive a heavier sentence than the previous criminal decision. "Because this is the second time, the punishment could be greater," he said. In this case, WJM from Switzerland, who now has the status of an Indonesian citizen, was named a suspect along with the Director of PT Gerbang NTB Emas (GNE), a Regional Owned Enterprise (BUMD) owned by the NTB Provincial Government, with the initials SH.

Both were named as suspects by referring to criminal violations of Article 70 letter D in conjunction with Article 49 paragraph (2) of the Republic of Indonesia Law Number 6 of 2023 concerning the stipulation of Government Regulation in Lieu of Law no. 2 of 2022 concerning Job Creation and/or Article 68 letters A and B as well as Article 69 letters A and B of Law no. 17 of 2019 concerning Water Resources jo. Article 56 of the 2nd Criminal Code.
