The Constitutional Court's Decision Must Be Obstructive And As It Is

JAKARTA PPI executive director Adi Prayitno hopes that the Panel of Judges of the Constitutional Court (MK) will make an objective decision and there will be a dispute over the 2024 presidential election, which is full of political content.

"The public reads the current Constitutional Court judge's decision cannot be separated from the political aspect. Especially it has to do with the decision 90 regarding the conditions for the presidential election. It is natural that the dispute over the election results in the Constitutional Court is also associated with political elements," he said, Sunday, April 21, 2024.

According to him, although the Constitutional Court's decision will be interpreted politically, public trust is certainly better at this time. Especially after the Constitutional Court replaced its chairman, Anwar Usman, who was considered the cause of the neutrality in the Constitutional Court.

"The chairman of the Constitutional Court has been replaced, practically public trust has begun to rise to the Constitutional Court. Many decisions of the Constitutional Court are also appreciated by the public. For example, regarding the lower parliamentary threshold," he added.

Therefore, the public certainly hopes that the decisions issued regarding the 2024 presidential election dispute must be objective and fulfill a sense of legal justice. If indeed the evidence submitted by candidate pairs 1 and 3 is invalid, then the constitutional judge must declare invalid and reject their request for re-election or disqualification.

"On the other hand, if the evidence submitted is valid and must be re-election or disqualification, you have to say what it is. The key is objective and integrity to save democracy," said Adi.

As is known, the 2024 presidential election dispute trial starts on March 27, 2024. In a marathon, the Constitutional Court schedules the agenda for the trial stage by stage, starting from listening to the petitioner's petition, the respondent's answer, and related parties. The plan, the Constitutional Court will decide the case on Monday, April 22.
