JAKARTA - Deputy Chairperson of the PKS Shura Council, Hidayat Nur Wahid, responded to the statement of the former Chief Justice of the Constitutional Court (MK), Jimly Asshiddiqie, who said that the right to inquiry allegations of election fraud was only political clashes.
Hidayat considered that this assumption was disproportionate because it was part of the political rights of members of the DPR RI.
"Some have discussed that the right of inquiry is only a political buzz, and it is submitted by the losing party. That is clearly not true and disproportionate, because the right of inquiry is a constitutional political right owned by the DPR," Hidayat said in Jakarta, Friday, February 23.
According to the Deputy Chairperson of the MPR, the right of inquiry can still be used by all factions in the DPR whether or not there is a 2024 election winner. The right of inquiry, said Hidayat, can be used based on the calculation of the interim votes, without waiting for the final results.
"So even if it is only based on a temporary calculation, this right of inquiry remains constitutionally owned by the DPR, even though the initial proposer for the DPR to make the right of inquiry is the presidential candidate promoted by the largest political party in the DPR, the winner of the legislative election, namely PDIP. After all, those who will apply will still be members of the factions in the DPR," he explained.
Hidayat said, there were no obstacles for council members to use their right to inquiry. Provided, the right of inquiry is proposed by at least 25 members of the DPR who come from more than one faction in the DPR.
"As long as these conditions are met, there are no obstacles to the right of inquiry being used and no constitutional rights of anyone, let alone parties outside the DPR, to make noise by framing negatively and rejecting the right of inquiry by the DPR,” concluded.
Previously, former Chief Justice of the Constitutional Court (MK), Jimly Asshiddiqie, previously assessed that the proposal of presidential candidate number 3, Ganjar Pranowo, regarding the right to inquiry allegations of fraud in the 2024 presidential election was not enough time to be realized.
