Yusril Mocks AHY's Democrats for Handing Over Material Examination to the Ministry of Law and Human Rights

JAKARTA - The feud of former Democratic cadre lawyer Yusril Ihza Mahendra with his subordinate Agus Harimurti Yudhoyono (AHY) continues. After the war of words about Adolf Hitler, now the two are sarcastic about the rules for submitting files related to the AD/ART material review to the Ministry of Law and Human Rights.

Yusril responded with a smile about the activities of the Democratic Party (PD) for the AHY camp, which submitted the file to Yasonna H. Laoly's office. Because according to him, everyone knows that the judicial review is submitted to the Supreme Court, not to the Ministry of Law and Human Rights.

"Has the judiciary shifted to the Ministry of Law and Human Rights now, huh?" said Yusril in his written statement, Sunday, October 17.

Yusril explained that all court matters had been handed over to the Supreme Court in 2004 and that happened when he was the Minister of Justice and Human Rights. The documents submitted by lawyers and top officials from the Democratic Party to the Ministry of Law and Human Rights consist of responses to JR's application submitted by four PD members who were fired through Yusril.

In addition, he said, evidence was submitted as well as expert testimony from five legal experts. What also surprised him, according to Yusril, was the submission of the revocation of the power of attorney for judicial review from one applicant.

"Well, are they really the Petitioners' lawyers?" Yusril explained.

Yusril said that normally the power of attorney revoked the power of attorney to the attorney who was authorized, not the lawyer of the opposing party in the case. It is the applicant's attorney who submits and notifies the court that an applicant has revoked his power of attorney.

"I myself as the recipient of the power of attorney have not received the revocation of power," said Yusril. The existence of the revocation of power of attorney is in the hands of lawyers and top Democrats, he said, actually raised suspicions.

"Could it be the spirit of Adolf Hitler who ordered to revoke the power of attorney," said Yusril jokingly.

Yusril assessed that the lawyers and top officials from the Democratic Party did not know what to do with JR before going to the Supreme Court. Meanwhile, the Minister of Law and Human Rights is the respondent in this case.

"As an advocate who has been in the judiciary for quite a long time, this is the first time I have witnessed a crowd of lawyers coming to submit answers, evidence, and expert statements to the Respondent," said Yusril.

Yusril also responded to statements from the former Secretary-General of the Democratic Party Hinca Pandjaitan and the legal team of the DPP Democrat Mehbob. Yusril said that any person or legal entity, as long as they have legal standing, can test any regulations they want.

Yusril gave an example of the village head who made a regulation in the village head that people were allowed to live in his village only Muslims or Christians. Adherents of other religions are not allowed because the village is a 'Muslim village' or a 'Christian village'. Yusril said the village headman could be tested by the Supreme Court because it was against the Human Rights Law, the Village Administration Law, and the Government Administration Law.

"Just go ahead if you want to test it as long as it has legal standing. There will be no legal chaos because the village head is being tested. Chaos will actually occur if the village head is left alone and eventually riots arise because the village chief ignores protests," said Yusril, giving an example.

"A party's army can be tested with the Political Party Law and the Human Rights Law, for example, if the party adheres to Nazi ideology which is contrary to Pancasila. The party leadership structure reflects the pattern of dictatorship and nepotism that is contrary to democracy as regulated in the Political Party Law. so that it will be canceled. There will be no chaos because the army of political parties is tested in the Supreme Court. Those who say it is chaotic are the status quo or 'Adolf Hitler group' who want to defend their interests in the party. Chaos will actually occur if the army of political parties is left like that," said Yusril.

Responding to Yusril's insinuation, Head of the PD Bakomstra Herzaky Mahendra Putra explained about the documents submitted by Democrats to the Ministry of Law and Human Rights a few days ago. Democrats believe the documents they submitted can help the Ministry of Law and Human Rights break the lawsuit for judicial review of AD/ART.

"We went to the Ministry of Law and Human Rights to submit various evidence and documents which, in our opinion, could help the Ministry of Law and Human Rights counter the legal manipulation efforts carried out by Yusril through a judicial review at the Supreme Court. Kemenkumham, because we can't go to court directly," said Herzaky.
