SERANG - The Banten Provincial Government (Pemprov) filed a memorandum of cassation against the decision of the Jakarta State Administrative High Court (PT TUN) which won the lawsuit against PT Modern Industrial Estate or Modern Cikande regarding the ownership of Situ Ranca Gede in Babakan Village, Bandung District, Serang Regency.

Head of the Regional Financial and Asset Management Agency (BPKAD) of Banten Province, Rina Dewiyanti, said that the cassation step was taken after coordinating with the Banten High Prosecutor's Office as the State Attorney (JPN).

"Last Tuesday we had a meeting with the JPN team regarding the cassation memory that we will propose. On September 24, we last submitted a memorandum of cassation," said Rina in Serang City, Antara, Monday, September 22.

According to him, the Banten Provincial Government continues to strive to re-record the area of about 25 hectares as regional assets.

"Hopefully the next decision will be better. We must try until the last legal action," he said.

The panel of judges led by Ariyanto with members Achmad Hari Arwoko and Sumartanto assessed that the building use rights certificate (SHGB) belonging to PT Modern Cikande is still legally valid and has not been canceled by the competent authorities.

"If the Defendant (Banten Provincial Government) feels aggrieved by the Plaintiff's SHGB (PT Modern Cikande), the Defendant should have taken the available procedures in accordance with applicable laws and regulations," the judge considered.
