Application For Revocation Of Lawsuit By Marzuki Alie And Partners Was Granted By Central Jakarta District Court

JAKARTA - The Panel of Judges at the Central Jakarta District Court (PN) has granted the request to withdraw Marzuki Alie's and five other politicians' lawsuits regarding dismissal from the membership of the Democratic Party. The withdrawal of the lawsuit was determined in a trial by the Chief Justice of the Panel of Judges, Rosmina.

After the trial, a member of the plaintiff's legal team, Slamet Hasan, explained that the lawsuit was withdrawn because dismissal from the Democrat Party was no longer relevant to question.

Given, the status of the plaintiffs has been restored in the extraordinary Congress (KLB) Democrats in Sibolangit, Deli Serdang, North Sumatra, on March 5.

"The second, Mr. Marzuki Alie, and his friends (the plaintiffs, ed) argued that they would concentrate and take care of the ratification of the Democrats (Extraordinary Congress version) at the Ministry of Law and Human Rights (Kemenkumham)," said Slamet when contacted by Antara, Friday, March 26.

Meanwhile, the Legal Counselor representing the three administrators of the Central Executive Council (DPP) of the Democratic Party, Mehbob, when met after the trial on Friday, said that the withdrawal of the lawsuit was carried out because of the legal standing of the plaintiffs was weak.

"The gang (of the plaintiffs) withdrew the lawsuit before facing the battle because he thought their legal standing was weak because this is a matter of political parties, they will definitely return to the Party Court," explained Mehbob.

"The Panel of Judges has decided to withdraw (the lawsuit). So I think the problem is over,” said Mehbob referring to lawsuit number 147/Pdt.Sus-Parpol/2021/PNJkt.Pst, which was filed by the plaintiff on March 8.

Previously, Former Chairman of the Indonesian Parliament Marzuki Alie filed a lawsuit against the son of the 6th President of the Republic of Indonesia Susilo Bambang Yudhoyono (SBY), Agus Harimurti Yudhoyono (AHY) as the General Chair of the Democratic Party to the Central Jakarta District Court.

Apart from Marzuki, there are four other names, such as Tri Yulianto, Darmizal, Achmad Yahya, Yus Sudarso, and Syofwatillah Mohzaib, all of the plaintiffs. On the other side of the defendant, apart from AHY, there were the names of the Secretary-General of the Democratic Party, Teuku Riefky Harsya, and the Chairman of the Honorary Council of the Democratic Party's Central Executive Council (DPP), Hinca Panjaitan.

However, the plaintiff's legal team during the first trial on Tuesday, March 23 then submitted a request to withdraw the lawsuit to the Panel of Judges led by Rosmina. Regarding the petition, Rosmina welcomed the plaintiffs' decision.

"We are very happy if this can be resolved outside the court. This is progress not using the court,” said Rosmina in response to the plaintiff's legal counsel during the trial at the Central Jakarta District Court, Tuesday.
