JAKARTA - Former President Director of PT Garuda Indonesia (Persero) TbkEmirsyah Satar was sentenced to five years in prison and a fine of Rp. 500 million, subsidiary to three months in prison in a case of alleged corruption in aircraft procurement at Garuda Indonesia.
"The defendant Emirsyah Satar has been legally and convincingly proven guilty of committing a criminal act of corruption together as in the primary indictment of the public prosecutor," said Chief Judge Rianto Adam Pontoh at the trial of reading the verdict of the panel of judges at the Jakarta Corruption Court (Tipikor) reported by ANTARA, Wednesday, July 31.
Emirsyah was found guilty of violating Article 2 paragraph (1) in conjunction with Article 18 of Law Number 31 of 1999 concerning the Eradication of Criminal Acts of Corruption as amended by Law Number 20 of 2001 in conjunction with Article 55 paragraph (1) of the 1st Criminal Code (KUHP).
The panel of judges also imposed additional penalties on EmirsyahSatar in the form of payment of replacement money in the amount of 86.36 million US dollars which must be paid no later than one month after the decision has permanent legal force.
If Emirsyah does not pay, then his property will be confiscated to cover the replacement money, provided that if the convict does not have sufficient property, he will be replaced by a subsidiary with imprisonment of two years.
Pontoh explained that in giving the verdict, the panel of judges considered several aggravating and mitigating factors.

The verdict handed down to Emirsyah was lighter than the demands of the public prosecutor, namely eight years in prison and a fine of Rp. 1 billion, subsidiary to six months in prison.
