Fahzal said Sadikin had been legally and convincingly proven guilty of embezzling corruption as the three public prosecutors' alternative charges.
Thus, Sadikin was proven to have violated Article 11 in conjunction with Article 15 of Law (UU) Number 31 of 1999 concerning the Eradication of Criminal Acts of Corruption as amended by Law Number 20 of 2001.
In addition to determining the sentence, the panel of judges determined that Sadikin's arrest and detention period had been reduced entirely from the sentence imposed, assigned Sadikin to remain in detention, and charged Sadikin with a court fee of Rp. 5,000.
He revealed that there were several things that aggravated the verdict, namely Sadikin, assisting the defendant Achsanul as the state administrator in committing a criminal act of corruption and feeling innocent in the case.
Meanwhile, several mitigating things, namely Sadikin being polite in front of the trial, did not complicate the proceedings, and had never been convicted.
In prison and fines, Sadikin was also subject to the same sentence as Achsanul, namely 2 years and 6 months in prison and a fine of Rp250 million.
However, when compared to the demands, Sadikin's sentence tends to be heavier than Achsanul because previously Sadikin was sentenced to 4 years in prison and a fine of Rp. 200 million, subsidiary to imprisonment for 3 months, while Achsanul was sentenced to 5 years in prison and a fine of Rp. 500 million.
"This is because Sadikin does not want to admit that he is guilty, while Achsanul has already regretted and pleaded guilty," added Fahzal.
Sadikin was proven to be an intermediary when Achsanul received a bribe worth US$2.64 million or equivalent to Rp40 billion to conduct an examination of the BTS 4G BAKTI Kominfo project which will be carried out in 2021.
The bribe money was received from the Director of PT Multimedia Berdikari Sejahtera Windi Purnama with the source of money from the Commissioner of PT Solitech Media Synergy Irwan Hermawan on the orders of former President Director of BAKTI Kominfo Anang Achmad Latif to be handed over to the defendant through Sadikin.
The provision of bribes with the intention that Achsanul helps check the work of BTS 4G 2021 carried out by BAKTI Kominfo in order to get fair results without exception (WTP) and find no state losses in the implementation of the project.
