ICW Asks The National Police Chief To Temporarily Dismiss AKBP Brotoseno

JAKARTA - Indonesia Corruption Watch (ICW) has asked the National Police Chief General Listyo Sigit Prabowo to temporarily suspend Grand Commissioner Adjutant (AKBP) Raden Brotoseno, from his position so that he can focus on the judicial review (PK) of the decision of the Indonesian National Police Code of Ethics Commission (KKEP).

"Considering that the review process until the final decision takes quite a long time, ICW asks the National Police Chief to temporarily suspend Brotoseno from his position so that he can then focus more on undergoing ethical trials," said ICW researcher Kurnia Ramadhana, quoting Antara, Sunday, June 19.

It is known, in January 2017 the Jakarta Corruption Court sentenced Grand Commissioner Adjutant Raden Brotoseno to five years in prison and fined IDR 300 million for being involved in corrupt practices (bribes).

Grand Commissioner Adjutant Raden Brotoseno has been on parole since February 15, 2020. He is considered to have met the administrative and substantive requirements to get the right of remission and parole in accordance with the Regulation of the Minister of Law and Human Rights of the Republic of Indonesia Number 3 of 2018.

Based on the results of the enforcement of the form of the KEPP violation, Grand Commissioner Adjutant Raden Brotoseno in October 2020, it was stated that the person concerned did not carry out his duties professionally, proportionally, and procedurally in the form of his actions while serving as Kanit V Subdit III Dittipidkor Bareskrim Polri, namely accepting bribes from suspects in suspected corruption cases.

However, Brotoseno was only sanctioned by demotion and asked to apologize to the leadership of the Bhayangkara Corps.

Later, Grand Commissioner Adjutant Raden Brotoseno is known to have returned to being active as a member of the National Police, and has even hosted an event from the Directorate of Cyber Crime and Criminal Investigation of the Police which was broadcast via the YouTube channel. This has caused a polemic in the community that questioned the seriousness of the Police in eradicating corruption.

The police responded to public protests by issuing new rules, namely Police Regulation (Perpol) Number 7 of 2022 concerning the Professional Code of Ethics and the Indonesian National Police Code of Ethics Commission.

Perpol replaces the National Police Chief Regulation (Perkap) No. 4 of 2011 concerning the Police Code of Ethics and Perkap No. 19 of 2012 concerning the Organization and Work Procedure of the Police Code of Ethics Commission. Officially promulgated and signed by the Minister of Law and Human Rights Yosanna H Laoly on 15 June 2022.

Article 83 of Police Regulation (Perpol) Number 7 of 2022 regulates the review (PK), which is not regulated in Perkap Number 14 of 2011 and Perkap Number 19 of 2012.

The National Police Chief has the authority to review the KKEP decision or the appeal KKEP decision which is final and binding, where the review is carried out no later than three years after the KKEP decision or KKEP Appeal decision to conduct an examination of Brotoseno's absurd decision which was judged to have had many irregularities in his previous ethical trial.

ICW also encourages that the escalation of the handling of the review can be increased to a retrial of the code of ethics and the final decision is to dishonorably dismiss (PTDH) Brotoseno.

"For us, the National Police Chief should no longer hesitate to speed up the review process because the consideration of Brotoseno's ethical decision was very problematic," said Kurnia.
