Using GoTo Name, Gojek And Tokopedia Are Reported To The Police

JAKARTA - PT Aplikasi Karya Anak Bangsa (Gojek) and Tokopedia were reported by PT Terbit Financial Technology to the Metro Jaya Police. The report relates to the use of the GoTo name.

"(Reported) Tokopedia and Gojek with their four CEOs," said PT Terbit Financial Technology's attorney, Alfons Loemau to reporters, Tuesday, November 9.

This case began when Gojek and Tokopedia worked together. Where, in the collaboration, it was decided to use the name GoTo.

In fact, that name has been used by PT Terbit Financial Technology as the name of an application in the field of open source software development services adopted by blockchains.

Although the names are used there are differences, namely the use of capital letters or 'GOTO'.

In fact, the name has been registered with the Director-General of Industrial Property Rights, Ministry of Law and Human Rights under the brand number IDM00085218 class 42 dated March 10, 2020.

"The use of the GoTo brand by PT Aplikasi Karya Anak Bangsa and PT Tokopedia was carried out without prior recognition of brand rights and of course violated the rights to the complainant's 'GOTO' brand," said Alfons Loemau.

Meanwhile, another lawyer, Serfasius Serbaya Manek, said that by using a similar name, his client suffered a loss of up to IDR 1.2 trillion. Because many investors are discouraged because of the similarity of trademarks.

"The real material loss that occurred was more than IDR 200 billion. The immaterial loss was more than IDR 1 trillion," said Serfasius.

In the report, Gojek and Tokopedia were reported with Article 100 paragraph 2 and/or Article 102 of Law No. 20 of 2016 concerning Trademarks and Geographical Indications.
