JAKARTA - Deputy Chairman of the Corruption Eradication Commission (KPK), Nurul Ghufron, emphasized that the death penalty for a convicted criminal is only applied to corruption crimes that harm state finances under certain conditions.

"Certain conditions are intended, such as corruption in the budget for natural disasters, the corona outbreak, as well as the condition of the country in a state of crisis", said Ghufron in Ambon, quoted by Antara, Wednesday, November 3.

Ghufron's assertion was delivered after conducting socialization at the "Coordination Meeting for the Integrated Corruption Eradication of the Maluku Region 2021 to the Leaders and Member of the Provincial People's Representative Council".

According to him, the KPK is based on Law No. 31 of 1999 as amended by Law No. 20 of 2001 regarding the application of the death penalty for corruption crimes that occurred as stated in Article 2 paragraph (2).

This article regulates corruption which is detrimental to state finances under certain conditions, such as crises or natural disasters or the COVID-19 pandemic.

"There is no limit to the value of the corrupted budget for violations like this, most importantly there is state loss by the provisions of Article 2 paragraph (2) of the Anti-Corruption Law, which occurs under certain conditions", he said.

For handling corruption cases in Maluku, said Ghufron, the KPK always coordinates regularly, not only with the public service agency but also with law enforcement officers, such as the police, the Attorney General's Office, and the Financial and Development Supervisory Agency of the Republic of Indonesia of Maluku Province Representative.

Ghufron said that it was not only the KPK that carried out the process of upholding the rule of law but other law enforcement officers who carried out the same task so that they were linear in front of the Indonesian people. The process of enforcing the rule of law will be carried out by anyone, but with the same treatment.

"If there are reports of alleged criminal acts of corruption, action will certainly be taken, and if there are allegations, the KPK will carry out investigations up to the prosecution", he continued.

Regarding the coordination meeting which was guided by the chairman of the Maluku Regional House of Representatives, Lucky Wattimury, he expressed the spirit of the KPK and the legislature to jointly supervise, guard, control, and regulate Maluku Province in advancing the region to be just and prosperous.

"Because the Regional House of Representatives is actually an institution established by the state to control. KPK has the same spirit and function, namely to supervise and enforce the law", said Ghufron.

"If the Regional House of Representatives functions to exercise political control, then the KPK oversees it from a legal perspective, but the spirit and purpose are actually the same", he said.
