In Palopo, South Sulawesi, Ricardo Gelael's KFC Sued Rp4 Billion By Consumers Due To Orders Not Matching Applications
JAKARTA - The management of a fast food restaurant owned by entrepreneur Ricardo Gelael, Kentucky Fried Chicken (KFC) was sued by his customer, Erwin Sandi in Palopo City, South Sulawesi. Erwin sued KFC to the Palopo District Court for Rp4 billion following allegations of public deception for orders that did not match the application.
"We are officially filing a civil lawsuit because an open apology cannot be carried out by them (KFC Palopo management)," said Erwin, quoted from Antara, Friday, January 14.
The lawsuit in the form of a breach of contract to the Palopo District Court has been registered on the official website of the Palopo District Court with case number 3/Pdt/G/2022/Pn Plp.
The lawsuit refers to Article 62 paragraph 1 of Law Number 8 of 1999 concerning Consumer Protection with a fine of Rp2 billion. The plaintiff also demanded immaterial losses of Rp2 billion to the defendant KFC Palopo.
Besides KFC Palopo, he also sued the online transportation service provider company (Gojek), both the company and its partners (drivers) not for fines but for improving their services.
Erwin said that until now an open apology has not been carried out by the management, related to the problem that the hamburger order for his son did not match the picture in the application that was delivered by an online motorcycle taxi on November 15, 2021, to his home at that time.
The food he received was not equipped with mayonnaise, vegetables, and sauce, which made him disappointed and felt cheated by the restaurant. Likewise, a similar order ordered on November 13, 2021, also does not match the image in the application.
Erwin said that although there was a mediation process with the management of KFC Palopo, with four points of demands such as an open apology. Improved customer service does not sell incomplete meals.

"They only want to apologize privately and not openly. At that time it was done in mediation in November, but they still don't want to apologize publicly. Not only have I become a victim, but there have been many," explained Erwin.
Confirmed separately, KFC Sulawesi Area Manager Darman told reporters that regarding the issue with the lawsuit, he could not comment much, and would hand it over to the company's attorney for legal assistance.
"I have a superior, and I can't comment yet because it's legal if it's like that. That means, the route is to a lawyer with a lawyer. God willing, management is ready (to face a lawsuit)," he said.
