16 Witnesses Examined Regarding Denny Indrayana's Case

JAKARTA - The investigation into the alleged leak of the Constitutional Court (MK) decision regarding the judicial review of the legislative election system with reported Denny Indrayana is still ongoing, because investigators from the Directorate of Cyber Crime (Dittipidsiber) of the National Police Criminal Investigation Unit continue to dig up information from a number of witnesses examined.

According to the Director of Cyber Crime at the National Police, Brigadier General Adi Vivid A Bachtiar, 16 witnesses have been examined so far, but have not examined Denny Indrayana as the reported person.

"For the witnesses in us, we have examined approximately six expert witnesses, then the other witnesses are approximately 10," Vivid said as quoted by ANTARA, Tuesday, August 8.

Vivid said that his party had not asked for information from Denny Indraya because he was abroad.

His party immediately invited Denny Indrayana to be asked for clarification, but had not yet mentioned when the invitation letter would be sent.

"Incidentally, what we know is that Mr. Denny Indrayana is in Australia," said Vivid.

Investigators have upgraded the status of handling cases from the investigation stage to the investigation stage by sending a notification letter for the start of the investigation (SPDP) to the Attorney General's Office on Monday (10/7).

The submission of the SPDP means, investigators informing the Prosecutor's Office that the investigation process of a case has begun, so that later, the Indonesian Attorney General's Office will appoint a research prosecutor (P-16) who will examine the completeness of the case file for evidence at trial.

Denny Indrayana was reported for alleged hate speech (SARA), hoaxes, insults to the authorities and leaks of state secrets as referred to in Article 45 A paragraph (2) in conjunction with Article 28 Paragraph (2) of Law no. 19 of 2016 concerning amendments to Law no. 11 of 2008 concerning ITE and/or Article 14 Paragraph (1) and Paragraph (2) and Article 15 of Law no. 1 of 1946 concerning Criminal Law Regulations and/or Article 112 of the Criminal Code and/or Article 112 of the Criminal Code and/or Article 207 of the Criminal Code.
