Bareskrim Unloads Naughty Practices Of Fake Oil In East Java, 36,933 Bottles Confiscated

JAKARTA - The Directorate of Certain Crimes, Bareskrim Polri, exposed the naughty practice of making and circulating counterfeit oils in East Java. From the disclosure, 36,933 bottles of counterfeit oil of various brands were confiscated.

"Disclosure of cases or criminal acts of production and circulation of counterfeit oil in two districts, namely Gresik and Sidoarjo, East Java," said Director of Certain Crimes at the National Police Criminal Investigation Agency Brigadier General Hersadwi Rusdiyono to reporters, Thursday, June 8.

Disclosure of the naughty practice began with information received by the investigative team. Then, it was developed by looking for evidence and clues.

Until finally, 9 storage warehouses were found in the two districts in East Java.

"There are 9 warehouses, the first is 6 warehouses in the Legundi Business Park industrial warehouse area, Driyorejo District, Gresik Regency, East Java Province," he said.

"Then there is a warehouse in the warehouse area of the Legundi Sumo Estate industry, Driyorejo District, Gresik Regency, East Java Province and 2 warehouses in the Satria Eco Park warehouse area, Krian Bypass Street, Sidoarjo Regency, East Java," continued Hersadwi.

Then, from the disclosure, 5 people were named as suspects. The brands with the initials AH, AK, FN are business owners, as well as AL alias TOM and AW alias JERRY who play a role in the operational department.

Not only arresting suspects, several pieces of evidence were also secured, namely, tens of thousands of bottles of fake oil for motorbikes and cars ready to be distributed.

"For the evidence that we confiscated, there were 35,730 bottles of motorcycle oil of various types and branded well-known brands in 0.8 and 1 liter packaging boxes ready for distribution," said Hersadwi.

"1,203 pcs bottles of car engine oil of various types and branded well-known brands are packaged in 3.5 to 4 liter packaging boxes ready for distribution," he continued.

In addition, there are also 397,389 empty oil bottles of various brands and 284,530 oil bottles of various brands, as well as various production equipment machines used.

In this case, the suspects are suspected of having multiple articles, including Article 100 paragraph 1 and/or paragraph 2 of Law number 20 of 2016 concerning brands and geographical indications whose penalty is 5 years or a maximum fine of IDR 2 billion.

Furthermore, the article is subject to Article 120 paragraph 1 in conjunction with Article 53 paragraph 1 letter B of Law Number 3 of 2014 concerning industry with a maximum penalty of 5 years and a maximum fine of IDR 3 billion.

Then Article 62 paragraph 1 in conjunction with Article 8 paragraph 1 letter A and D of Law Number 8 of 1999 concerning consumer protection with a maximum penalty of 5 years in prison and a maximum fine of IDR 2 billion.

As well as Article 382 BIS of the Criminal Code in conjunction with Article 55 concerning fraudulent competition with a maximum penalty of 1 year and 4 months and a maximum fine of Rp. 13,500.
