South Sulawesi Prosecutor's Office Considers Cassation Of Free Sentences Of Ex-Kasatpol PP Iman Hud Corruption Defendant

The Public Prosecutor (JPU) of the South Sulawesi High Prosecutor's Office is still thinking about taking cassation steps after one of the defendants, former Head of Satpol PP Makassar City, Iman Hud, was declared innocent and was acquitted by the Panel of Judges for Corruption Crimes at the Makassar Class I A District Court.

"We are still waiting for steps and attitudes from the public prosecutor. Indeed, in front of the trial it was stated that we were thinking about it," said Head of the Information and Law Section of the South Sulawesi Prosecutor's Office, Soetarmi, quoted by ANTARA, Thursday, October 12.

In this case, there were two defendants, namely the former Kasatpol PP Makassar, Iman Hud and the former Head of the Operational Section of the Makassar Satpol PP Abdul Rahim. Both were named suspects on suspicion of corruption in the honorarium for the Makassar Satpol PP operational allowance in 14 sub-districts that cost the state finances amounting to Rp4.8 billion.

Previously, the Chief Justice of the trial, Purwanto S Abdullah, stated that in the trial on Wednesday, (11/10) the defendant Iman Hud was found not guilty of committing a criminal act of corruption in accordance with the public prosecutor's indictment.

"With this freeing the defendant from all charges (vrijspraak). Furthermore, restoring the defendant's rights in his abilities, positions, and dignity, as well as ordering evidence in the form of the public prosecutor's indictment not being fulfilled, the indictment must be declared unproven," said the judge.

: So legally the defendant must be declared not legally and convincingly proven guilty of committing the crime he was charged with. The costs of the case incurred are paid by the state," continued the judge.

Furthermore, the public prosecutor was given the opportunity to think about it. Whether to accept or file a legal action against the decision. Meanwhile, the defendant Abd Rahim was found guilty of a criminal act of corruption in accordance with the prosecutor's indictment.

Sentenced him to one year and six months in prison and a fine of Rp. 200 million, subsidiary to three months in prison. The defendant was also sentenced to an additional sentence of Rp. 12.2 million, subsidiary to one month in prison.

"The prosecutor and the defendant's legal adviser were given one week to think about it. If there is no legal action at that time, the decision will be declared legally binding," said the panel.

The Public Prosecutor's Team of the South Sulawesi Prosecutor's Office, Nining Purnamawanti, stated that his party was still thinking about it and for the next time the decision was reported to his leadership. Meanwhile, the legal adviser for the defendant Abd Rahim, namely Kusmianto, also expressed his thoughts and still used the time limit given by the panel of judges. Meanwhile, Iman Hud's legal adviser, Abdul Gafur, welcomed the decision, because he was optimistic that his client was not guilty.
