KPU's Explanation Regarding The Proposal For The Revision Of PKPU To Commission II Of The DPR As A Result Of The Constitutional Court's Decision

The General Election Commission (KPU) proposes a change in Article 13 Paragraph 1 Letter q of PKPU Number 19 of 2023 concerning the nomination of registration for presidential and vice-presidential election participants to the DPR and the government. The proposed amendment is to follow up on the decision of the Constitutional Court (MK) Number 90/PUU-XXI/2023.

It is known, Article 13 Paragraph 1 Letter q of PKPU Number 19 of 2023, initially required that presidential and vice-presidential candidates should be at least 40 years old. Then the Constitutional Court made an exception for someone who had served through elections, including the Pilkada.

"In the draft PKPU amendment Number 19 of 2023 to Article 13 Paragraph 1 Letter q, the condition for becoming President and Vice President is Letter q, 'at least 40 years old or having been in the position elected through elections including regional head elections'," said Chairman of the Indonesian KPU Hasyim Asy'ari in a hearing with Commission II of the DPR, Tuesday, October 31.

Hasyim explained that adjustments were needed to be made to the PKPU as a result of the Constitutional Court's decision. So he said, the KPU submitted a change to the DPR.

"The consideration that we submitted is the first that in connection with the decision of the Constitutional Court Number 90/PUU-XXI/2023, it is necessary to make adjustments and improvements in KPU Regulation Number 19 of 2023 concerning the nomination of general election participants for the President and Vice President regarding the terms of age as candidates for President and Vice President," he explained.

"Secondly, that based on the consideration as referred to in letter a, it is necessary to establish a KPU Regulation regarding amendments to KPU Regulation Number 19 of 2023 concerning the nomination of presidential and vice presidential election participants," he continued.

Apart from PKPU, tonight's meeting will also discuss the draft Perbawaslu. Deputy Chairman of Commission II of the DPR Junimart Girsang hopes that the meeting will run smoothly while remaining in the corridor of the law.

"Because frankly, legally, if we talk about the basic law of implementing Law 17 or PKPU, it cannot be violated. We will ask the KPU how it actually is valid in one registration process and what about the legal consensus, later they must answer," said Junimart at the DPR building, Tuesday, October 31.

Junimart added that all parties must also respect the MKMK which is currently working. Where a decision will be made on November 7th.

"Don't forget that the KPU is being sued at the Central Jakarta District Court on the basis of against the law, later we will ask the KPU to explain later that we will respond to it in Commission II," said Junimart.
