Prosecutors Demand 6 Years In Prison For Former Principal In North Tapanuli, Defendant Of Corruption In BOS Funds
The prosecutor demanded a six-year prison term for former Head of SMAN 1 Purbatua, North Tapanuli Regency, Waston Saragih, for alleged corruption in school operational assistance funds (BOS).
"In addition, Waston Saragih is also subject to a fine of Rp. 200 million, subsidiary to six months in prison," said Public Prosecutor's Office for Taput Satria Agustina at the Medan District Court, North Sumatra (North Sumatra), Thursday, October 5, which was confiscated by Antara.
He continued, from the facts of the trial, the defendant had fulfilled the elements of committing a criminal act of Article 2 paragraph (1) in conjunction with Article 18 of the Republic of Indonesia Law No. 31 of 1999 concerning the Eradication of Criminal Acts of Corruption as amended and supplemented by Law No. 20 of 2001 concerning Amendments to Law No. 31 of 1999 concerning Eradication of Criminal Acts of Corruption as in the primary indictment.
The defendant committed acts of enriching himself or other people or a corporation that could harm state finances Rpp609,484,000 from BOS funds for the 2019 fiscal year.
"Therefore, the defendant Waston Saragih is subject to an additional penalty of paying compensation (UP) of Rp. 609,484,000," said Satria Agustina.

However, he said if the defendant was unable to pay the replacement money no later than one month after the court's decision which obtained permanent legal force, then his property could be confiscated by the prosecutor and auctioned off to cover UP.
"If in this case the defendant does not have sufficient assets to pay UP, he will be replaced with imprisonment for three years," he said.
