Mataram High Court Adds Sentence Of KUR Corruption Defendant Lalu Irham To 15 Years
The Panel of Judges at the West Nusa Tenggara (NTB) High Court upheld the verdict of the first instance court for the defendant Lalu Irham Rafiuddin Anum in the corruption case of the people's business credit distribution program (KUR) at one of the conventional banks owned by the East Lombok Regency.Lalu Irham's verdict, which was originally 14 years old, was added to 15 years in prison."Sentenced Lalu Irham Rafiuddin Anum to 15 years in prison and a fine of Rp. 650 million, subsidiary to 4 months in prison," said Ni Made Sudani, chairman of the panel of judges at the appeal level in a live broadcast on the YouTube channel of the West Nusa Tenggara High Court, Mataram, Antara, Wednesday, 30 August.The panel of judges decided this decision by considering the facts of the defendant's actions as a third party that did not support the government's program in efforts to recover the national economy after the 2020 COVID-19 pandemic through the provision of interest subsidies for people's business loans (KUR) in the agricultural sector."That the defendant did not show empathy and humanity, so the decision of the Mataram District Court was correct and correct so it needed to be strengthened and considered by the panel of judges in the high court in making decisions," he said.Thus, Made Sudani together with members of the panel of judges I Wayan Wirjana and Diah Susilowati determined the decision based on the primary indictment of the public prosecutor.The primary indictment of the public prosecutor relates to criminal rules in Article 2 paragraph 1 in conjunction with Article 18 of Law Number 31 of 1999 concerning the Eradication of Criminal Acts of Corruption as amended by Law no. 20 of 2001 jo. Article 55 paragraph (1) 1st of the Criminal Code.In addition to determining the verdict, the panel of judges in the appeal level decision with the number: 6/PID.TPK/2023/PT MTR, also sentenced the defendant Lalu Irham to pay compensation for state losses in accordance with the first-degree court verdict of Rp29.1 billion, subsidiary to 5 years in prison.The panel of judges also determined that the defendant should remain in detention and evidence in the form of four-wheeled vehicles complete with STNK to be confiscated and auctioned for the state."The auction results were used to help cover the state compensation that was charged to the defendant," he said.Judges in the first instance court had previously explained that the losses imposed on Lalu Irham came from the results of the NTB BPKP audit of Rp29.6 billion which was deducted by credit repayment money by 14 debtors with a value of Rp476 million and money that still deposited in the debtor's account amounting to Rp7.9 million.
The judge considered this figure as a total loss from the transfer of KUR funds belonging to 779 corn farmers in East Lombok Regency to the account book of PT Mitra Universal Group (MUG) owned by the defendant Lalu Irham.
