Unable to live in Kampung Susun Bayam, Residents of JIS Evicted Administrative Appeal and Call the Provincial Government a Human Rights Violation

JAKARTA - Residents of Kampung Bayam who were affected by the eviction of the Jakarta International Stadium (JIS) construction have sent an administrative appeal letter to the DKI Jakarta Provincial Government because until now they have not been able to occupy Kampung Susun Bayam (KSB).

The LBH lawyer who assisted Kampung Bayam residents, Jihan Fauziah Hamdi, said that this administrative appeal was made because the DKI Provincial Government and PT Jakarta Propertindo (Jakpro) as the KSB manager still did not respond to the administrative objection letter they had previously filed.

"We submitted an administrative appeal because we followed up our process on February 20, our objections were not responded to by the Main Director of Jakpro and the Governor", said Jihan at the DKI City Hall, Thursday, March 16.

With no response from the government on this issue, the Bayam Villagers' Brotherhood (PKWB) views the DKI Provincial Government and JAkpro as having violated the law, namely

Governor Decree Number 878 of 2018, Governor Decree Number 979 of 2022 and Governor Regulation Number 90 of 2018.

These three regulations form the basis for carrying out the implementation of village arrangement where the Governor of DKI Jakarta as the mandate giver has the main responsibility to ensure that the village arrangement mechanism is carried out as it should, and can fulfil the right to proper housing.

"The actions taken were just the opposite, the DKI Jakarta Provincial Government did not provide shelter or accommodation for residents affected by the evictions and are waiting for the construction of Kampung Susun Bayam. Residents are left to build tents without any uncertainty", said Jihan.

Apart from that, continued Jihan, the residents of Kampung Bayam also view the Provincial Government of DKI and Jakpro as violating human rights (HAM).

"The actions of the Provincial Government of DKI Jakarta and JakPro violated human rights. This is shown by the DKI Jakarta Provincial Government never resolving the ownership disputes of Kampung Bayam residents. As a result, residents have to live in limbo, even 5 of their families have to camp in front of Kampung Susun Bayam because they no longer have the money to rent or find another place to live", he said.

Since Kampung Susun Bayam was inaugurated by former Governor of DKI Jakarta Anies Baswdan in October 2022, the evicted residents of Kampung Bayam have not been able to occupy the residence until now.

One problem that has caused residents to not settle in Kampung Susun Bayam is the amount of the monthly rental rate that has not yet been agreed upon. The JIS evicted residents did not agree with the tariff offered by PT Jakpro as the manager of Kampung Susun Bayam.

"They (Jakpro) use the tariff according to Governor Regulation No. 55 and we will drop it in general. Meanwhile, we are among the residents affected (by the eviction program). We object. We are part of the programmed residents", said the representative of Kampung Bayam residents, Shirley when met at City Hall DKI Jakarta some time ago.

"Residents want to pay according to their ability. If it's around IDR 150,000 per month, that should be the most. Because of income, sorry, scavengers and factory workers are only IDR 1.5 million", he stated.
