Overstay In Bali After Running Out Of Money, Egyptian Foreigner Who Was Almost 7 Months In A Detention House Was Finally Deported
BADUNG - Immigration Bali deported a foreign citizen (WNA) from Egypt with the initials KMHHM (37). The foreigner was deported for exceeding the limit of stay, or overstaying for more than 60 days.
Head of the Regional Office of the Ministry of Law and Human Rights (Kakanwil Kemenkum HAM) Bali Province, Anggiat Napitupulu said the foreigners were deported by Article 78 Paragraph (3) of Law Number 6 of 2011 concerning Immigration.
"Foreigners who hold a residence permit whose validity period has expired and are still in the territory of Indonesia for more than 60 days from the deadline for a residence permit will be subject to administrative immigration measures in the form of deportation and deterrence", said Anggiat, Wednesday, July 20.
It is known that an Egyptian foreigner entered Soekarno-Hatta Airport on February 2, 2020. He used a Visa On Arrival (VoA) to have a vacation to the Island of the Gods.
Furthermore, on February 24, 2021, the foreigner obtained an onshore visa with the sponsor of the wife in question and continued to extend it.
Until mid-June 2021, the foreigner's residence permit expires, but the person concerned has not left Indonesia. Finally, this Egyptian foreigner came to the Immigration Office for Class I Special TPI Ngurah Rai, on December 22, 2021.
The foreigner admitted that he did not have the money to buy a ticket and was detained for almost 7 months at the Immigration Detention Center (Rudenim) Denpasar, Bali.
In this case, the Special Class I Immigration Office of TPI Ngurah Rai stated that the person concerned had overstayed for more than 60 days.
"Although he argued that this was due to negligence, immigration can still carry out immigration administrative actions that are in line with the principle of ignorantia legis neminem excusat (ignorance of the law does not justify anyone)", said Anggiat.
