Jamwas Review Benny Tjokro's Report On Jiwasraya Case Investigators

JAKARTA - The Deputy Attorney General's Team for Supervision (Jamwas) of the Attorney General's Office is reviewing the complaint filed by Benny Tjokrosaputro (Bentjok). Benny Tjokro reported the alleged violation of the prosecutor's code of ethics in the investigation into the corruption case of PT Asuransi Jiwasraya's financial management and investment funds.

Jamwas Amir Yanto, said the report was reviewed by the Jamwas Inspectorate in charge of the Junior Attorney General for Special Crimes (Jampidsus).

"The (report) is still being studied, which is examining the Inspector regarding Jampidsus," said Amir, quoted by Antara, Thursday, June 3.

Amir admitted that he had read the report regarding the complaint from lawyer Benny Tjokrosaputro, which contained a more technical nature.

"The report material is technical and the case has been decided by the court," said Amir.

Previously, Benny Tjokrosaputro through his attorney, Fajar Gora, reported the AGO's Special Criminal Investigation Team (Pidsus) regarding alleged violations of the prosecutor's code of ethics in investigating the financial management and investment funds of PT Asuransi Jiwasraya.

The report relates to the omission of the Examination Report (BAP) of the witnesses in the case file, while the evidence confiscated from the witnesses was included in the case file.

According to the attorney, the investigator's actions will certainly harm Benny Tjokrosaputro. This is because the witnesses are said to be 'nominees' or parties whose names are lent in transactions in the capital market by Benny Tjokrosaputro. Meanwhile, the evidence that was confiscated from the witnesses was later named by the prosecutor as belonging to Benny and as evidence that his client (Benny) was in control of Jiwasraya's transactions.

In the absence of a BAP as a witness for the owner of the evidence in the case file, the owner of the evidence cannot be a witness in the trial.

This resulted in the witnesses unable to argue that the evidence did not belong to Benny and they were not Benny's 'nominees'. The subsequent impact, of course, is detrimental to Benny because there are no witnesses who deny Benny's control in every Jiwasraya transaction in the capital market.

On the other hand, Fajar Gora continued, the investigator's refusal to include 19 witnesses' BAP is also a violation of the investigation procedure. As well as a form of unprofessional action.

"Allegedly violating the Tri Krama Adhyaksa doctrine and working or acting unprofessionally," said Fajar Gora.

In addition to reporting the issue of not including the witnesses' BAP in the case file, Fajar Gora also reported the unprofessional actions of investigators in investigating the Jiwasraya case.

Among them is to impose all state losses in the Jiwasraya case to Benny Tjokrosaputro and Heru Hidayat. In fact, Jiwasraya bought 124 company shares in the capital market. And Benny's is only one of 124 other companies, namely PT Hanson International with the code MYRX.
