Constitutional Court Rejects Lawsuit Hengky Kurniawan-Ade Sudrajat, Jeje Govinda-Asep Ismail Sah Leads West Bandung

BANDUNG The Constitutional Court (MK) rejected the election dispute lawsuit filed by candidate pair number 3, Hengky Kurniawan and Ade Sudrajat. With this decision, candidate pair number 2, Jeje total Ismail or Jeje Govinda and Asep Ismail, officially lead West Bandung Regency.

The Constitutional Court assessed that the application for Dispute on General Election Results (PHPU) with case number 192/PHPU.BUP-XXIII/2025 was not supported by strong legal facts and evidence, so it was considered invalid.

"The verdict is to try in the exception, one: grant the exception of the respondent and the exception of related parties regarding the applicant's legal position. Two, reject the exception of the respondent and related parties for other and the rest. In the main application, it states that the petitioner's request cannot be accepted," said Chief Justice of the Constitutional Court, Suhartoyo, Wednesday, February 5.

In its decision, Constitutional Court Judge Daniel Yusmic explained that the Constitutional Court had observed the arguments of the applicant, the answers from the respondent, and the evidence submitted by all parties, including the West Bandung Bawaslu. The Constitutional Court found two main points in the lawsuit filed by Hengky-Ade.

First, the petitioner accused the existence of partiality and support from the Minister of Villages and Development of Disadvantaged Regions, Yandri Susanto, and the Presidential Special Envoy for the Development of the Young Generation and Art Workers, Raffi Ahmad, of the Jeje-Asep candidate pair.

"The Court stated that the argument was not supported by strong legal facts. The Petitioner also did not include evidence that could convince the court that the allegations were true," said Daniel.

Second, the petitioner alleges that there are structured, systematic and massive money (TSM) political practices in 11 sub-districts in West Bandung, including Cikalongwetan, Parongpong, Cililin, Cipat, Cipongkor, Nangga, Lembang, Padalarang, Gununghalu, Ngamprah, and Cipeundeuy.

However, after examining the available evidence and facts, the Constitutional Court found no indication of election violations or legal facts supporting the allegations.

"Therefore, the court does not believe in the truth of the things argued by the petitioner," said Daniel.

In addition, the Constitutional Court also ensured that all stages of the West Bandung Pilkada had taken place in accordance with applicable legal provisions.

"In this application, the Constitutional Court did not find any special conditions or events that could cancel the election results," he concluded.

With this decision, Jeje Govinda and Asep Ismail will certainly be sworn in as Regent and Deputy Regent of West Bandung.
