Johanis Tanak's Intention To Remove OTT Is Considered To Take The Heart Of The DPR RI

JAKARTA - Indonesia Corruption Watch (ICW) assesses that Johanis Tanak's intention to remove hand arrest operations (OTT) only aims to smooth his steps in the fit and proper test of the KPK leadership candidate (capim).

He is considered to be trying to win the hearts of members of Commission III of the DPR RI. So, Johanis can continue as a leader in the 2024-2029 period.

"The statement was made by Tanak no more than just to win the hearts of DPR members who tested it. Even though what he conveyed was clearly baseless and misleading," ICW researcher Diky Anandya told reporters quoted on Thursday, November 21.

Diky assessed that the KPK's OTT had to be planned, starting from the wiretapping process to stalking the perpetrators. "And when the suspect acts, the KPK can immediately make arrests," he said.

"And it should be understood that the wiretapping process itself as a planning process when it is about to carry out OTT has been explicitly mandated in Article 12 Paragraph 1 of the KPK Law," continued this anti-corruption activist.

The article reads as follows: "In carrying out the task of investigating and investigating as referred to in Article 6 letter e, the Corruption Eradication Commission has the authority to conduct wiretapping."

In addition, the terminology of hand arrest operations used by the KPK is also in accordance with Article 1 paragraph 19 of the Criminal Procedure Code. Thus, this active action still needs to be carried out.

In fact, Diky said the silent operation became a very powerful law enforcement instrument. "Despite the OTT, the KPK has recorded many successes in uncovering corruption crimes involving high state officials ranging from ministers, chairman of the DPR, to judges of the Constitutional Court," he said.

"If it is stated that he wants to remove OTT as a strategy in eradicating corruption, then this statement is a form to weaken the performance of the KPK," explained Diky.

As previously reported, Johanis Tanak received applause from members of Commission III of the DPR RI while taking the fit and proper test as candidates for the KPK leadership (capim). He said he would remove the hand arrest operation (OTT) if re-elected.

"If I could, please give permission, be the chairman, I would close, close because it (OTT, ed) is not in accordance with the understanding referred to in the Criminal Procedure Code," Johanis said in front of the legislators, Tuesday, November 19.

Johanis then mentioned the word 'operation' which was carried out when doctors and health workers had careful planning before acting. He said this understanding was different from the Criminal Procedure Code (KUHAP).

"While the meaning of being caught red-handed according to the Criminal Procedure Code is an incident that occurred instantly, the perpetrator was arrested and became a suspect," he explained.

"If the perpetrator commits an act and is arrested, of course there is no planning. If there is one plan, the operation is planned, the incident that occurs one moment is caught, this is an inappropriate overlap," continued the Deputy Chairperson of the KPK.
