Former Sestama Basarnas Charged With State Loss Of IDR 20.44 Billion

JAKARTA - Main Secretary (Sestama) of the National SAR Agency (Basarnas) for the 2009-2015 period Max Rudand Boseke was charged with harming state finances worth Rp20.44 billion related to the alleged corruption case in the procurement of trucks carrying 4WD personnel and rescue vehicles in 2014.

The Public Prosecutor (JPU) of the Corruption Eradication Commission (KPK) Richard Marpaung said the state loss was due to the fact that in this case, Max was suspected of having committed corruption together with the Director of CV Delima Mandiri William Widarta and the Head of the Sub-Directorate for Prosecution and Briefing of the Directorate of Facilities and Infrastructure of Basarnas Anjar Sulistiyono.

"The act of corruption aims to enrich Max by Rp. 2.5 billion and William by Rp. 17.94 billion," said the KPK prosecutor in a trial reading the indictment at the Jakarta Corruption Court (Tipikor), Thursday.

Thus, the three were charged with violating and being threatened with crime in Article 2 paragraph (1) or Article 3 in conjunction with Article 18 of Law (UU) Number 31 of 1999 concerning Eradication of Criminal Acts of Corruption as amended by Law Number 20 of 2001 jo. Article 55 paragraph (1) 1 jo. Article 65 paragraph (1) of the Criminal Code.

The prosecutor explained that the case began when Max became the Budget User Authority (KPA) for Fiscal Year (TA) 2014, Anjar was appointed as the Commitment Making Officer (PPK) for FY 2014, as well as the Head of Basarnas for the 2013-2014 period Muhammad Alfan Baharuddin was appointed as a User of the 2014 FY Budget based on Decree Number: SK.KBSN-167/XI/BSN-2013 dated 18 November 2013 which was signed by Alfan.

Sementara itu sejak tahun 2006, William telah mengikuti berbagai lelang pekerjaan pengadaan, termasuk lelang pekerjaan pengadaan di Basarnas dengan menggunakan CV Delima Mandiri.

In addition to using CV Delima Mandiri, William also uses various other companies in several procurement work auctions with the intention of winning the auction or as a companion company during the auction process, but CV Delima Mandiri has never won a job package auction at Basarnas.

For this reason, in March 2013, Max, who is familiar with William, told Alfan to include the work of procuring 4WD personnel trucks and rescue carrier vehicles (RCV) in the 2014 TA Work Program Proposal Revision.

The prosecutor revealed that the proposal was then approved by Alfan, so Max asked the Director of Facilities and Infrastructure of Basarnas Rudy Hendro Satmoko to enter the procurement of trucks carrying 4WD personnel and rescue vehicles in the 2014 TA Work Program Proposal Revision.

Furthermore, William together with Riki Hansyah and Yudi Muharam (each as the marketing staff of CV Delima Mandiri) prepared a price offer, technical specifications, and a vehicle image design for the truck procurement work to be handed over to the Planning Staff of the Directorate of Sarana and Infrastructure Basarnas Hafidh Rahmadi.

In price preparation, 15 percent has been added (mark up) with details of 10 percent for command funds and 5 percent for auction-winning company profits with two details.

First, in September 2013, Rudy signed the Term of Reference (TOR) of Land SAR Facilities for the work of procuring 75 units of the TA 2014 rescue vehicle with a unit price of Rp. 650 million or a total of Rp. 48.75 billion.

Second, in October 2013, Rudy signed the Land SAR ToRSarana for truck procurement work for 4WD TA 2014 personnel as many as 17 units with a unit price of Rp1.4 billion or a total of Rp23.8 billion.

After that on December 5, 2013, the Director General of Budget of the Ministry of Finance of the Republic of Indonesia signed a Certificate of Ratification of the Budget Implementation List (DIPA) of the 2014 TA Petkan Number SP DIPA-107.01.1.414370/2014, in which there is a budget for the procurement of trucks carrying 4WD personnel and rescue transport vehicles.

In detail, the procurement of trucks to transport 4WD personnel for 34 units at a unit price of Rp1.4 billion, bringing the total to Rp47.6 billion and 75 units with a unit price of Rp650 million, bringing the total to Rp48.75 billion.

However, without conducting a review of the procurement documents, the Public Prosecutor continued, Anjar made the procurement document a Work Reference Framework (KAK) and the basis for determining the Self Estimated Price (HPS) in procurement, so that HPS was not calculated based on expertise and was not based on accountable data.

Furthermore, William followed the auction process and carried out work by not complying with applicable regulations, resulting in state financial losses from the difference in excess disbursement of work implementation money amounting to Rp20.44 billion.

The difference came from the disbursement of the money for the procurement of 4WD personnel transport trucks amounting to Rp10.05 billion because there was a payment of Rp42.55 billion, while the realization of financing was only Rp32.5 billion.

In addition, the difference in disbursement of funds also came from the implementation of the procurement of rescue transport vehicles amounting to Rp10.38 billion due to payments of Rp43.54 billion, while the realization of procurement was only Rp33.16 billion.
