Bekasi Land Dispute, Minister Of ATR Nusron Says Cikarang District Court Has Not Yet Bagged A Request For Measurement

JAKARTA - Minister of Agrarian Affairs and Spatial Planning/Head of the National Land Agency (ATR/BPN), Nusron Wahid opened his voice regarding the eviction of houses and land disputes that occurred in Setia Mekar Village, South Tambun, Bekasi Regency, West Java.

Nusron believes that the Cikarang Class II District Court (PN) does not have a letter of application for measurement regarding this matter.

"That's right, he has written to me in 2022, but has not made a request for measurement," said Nusron when met in North Jakarta, Antara, Sunday, February 16.

However, according to Nusron, there is no application letter stating that the execution of land or eviction of five residents' houses in Bekasi will be carried out.

"Because the conditions before the execution of the court are not just a notification, yes, it is not just a notification. However, (there is also) a request for measurement to ensure whether the object to be executed is appropriate or not," said Nusron.

Nusron also emphasized that related parties must comply with procedures in accordance with the provisions of regulations and legislation before taking further action.

Moreover, there is no court decision that orders citizens' certificates to be canceled.

"We are a state of law, the rules are laws and regulations. Now, the rules are PP 18 of 2021, before there is an eviction or execution of the court, the court must first submit a measurement request," said Nusron.

"So, before carrying out the execution, it should first conduct a request process to the court to cancel the previous certificate," he added.

Furthermore, Nusron assessed that the application for the cancellation of the certificate should be submitted again to the State Administrative Court (PTUN) in order to order BPN to cancel the certificates owned by residents.

Previously, the Supreme Court (MA) denied that BPN was not involved in the execution of land in Setia Mekar Village, South Tambun District, Bekasi Regency, West Java, by the Cikarang District Court.

MA spokesman Yanto during a press conference at the Media Center MA, Jakarta, Thursday (13/2), said that before carrying out the execution, the Cikarang District Court had carried out a match by requesting assistance from the local BPN Office.

Based on the minutes dated September 14, 2022, Yanto added, the consolidation had been carried out without being attended by the respondent for execution and BPN.

Selain itu, kstatering juga disebut telah dilaksanakan dengan mengundang BPN, tetapi tidak hadir tanpa keterangan.

The execution carried out by the Cikarang District Court on January 30, 2025 was a delegation from the Bekasi District Court. Regarding the application for execution, the Bekasi District Court has issued a warning (amaning) to the respondents for execution to register the confiscation of the execution at the Bekasi Regency BPN.
