JAKARTA - Defendant I Nyoman Sukena has officially been under house arrest in the alleged case of protecting protected animals, namely, the Javan hedgehog, in accordance with the decision of the Denpasar District Court Judges. However, this status will soon end.

Kapuspenkum Attorney General's Office (AGO) Harli Siregar said that with this decision, I Nyoman Sukena would no longer be a prisoner of the Kerobokan Detention Center as of September 12.

"The person concerned has been transferred from detention to detention center to house detention since 12 September 2024," Harli told reporters, Tuesday, September 17.

The status of the house arrest is attached to I Nyoman Sukena for a week. Then, it will automatically disappear.

Because, the plan is for the man to undergo a trial reading the verdict on September 19. Where, that's when the panel of judges will determine the verdict to be given.

"The plan to read the judge's decision is scheduled for Thursday, September 19, 2024," said Harli.

The panel of judges at the Denpasar District Court, Bali, granted the request for a suspension of detention of Defendant I Nyoman Sukena, a resident of Bongkasa Pertiwi Village, Abiansemal District, Badung Regency, Bali, who maintains Javanese hedgehog or the Latin name Hystrix Javanica.

Chief Judge Ida Bagus Bamadewa Patiputra conveyed one of the things that were taken into consideration in granting the request, namely that the defendant Nyoman Sukena was the head of the family who was responsible for fulfilling the needs of his family's life.

"Your detention has been transferred to house arrests on the condition that they are cooperative. The defendant is also required to report twice a week every Tuesday and Thursday," said Bamadewa.

Meanwhile, in this case, the Public Prosecutor (JPU) of the Bali High Prosecutor's Office (Kejati) demanded the release of the defendant I Nyoman Sukena.

The prosecutor's consideration was that Nyoman Sukena was released because the defendant regretted his actions and the defendant did not intend to commercialize the hedgehog.

"Defendant I Nyoman Sukena was not legally and convincingly proven to have malicious intentions or an area to possess and maintain protected animals in the form of four Javanese hedgehogs," said Prosecutor Gatot.

"Freeing the defendant from Article 21 paragraph 2 letter a in conjunction with Article 42 paragraph 2 of the Republic of Indonesia Law, ordering the defendant to be expelled from detention, ordering evidence in the form of four Javan hedgehogs to be confiscated by the state to be handed over to the BKSDA," he added.
