Prosecutor's Office Confiscates 3 Fields Of Land Defendant Of Corn Seed Corruption Distanbun NTB, The Value Is Still Calculated By KPKNL

JAKARTA - The Prosecutor's Office executed three plots of land belonging to Aryanto Prametu, one of the convicts in the 2017 corruption case in the procurement of corn seeds at the West Nusa Tenggara (NTB) Agriculture and Plantation Service (Distanbun).

Spokesperson for the NTB High Prosecutor's Office (Kejati) Efrien Saputera said the prosecutor carried out the execution activities according to the decision to review Aryanto Prametu's Supreme Court with Number: 715 PK/Pid.Sus/2023.

"So, the follow-up to the execution is currently being carried out by the KPKNL (state wealth service office and auction) to be auctioned," said Efrien in Mataram, Tuesday, August 20, as reported by Antara.

The auction results, he continued, will be used by the prosecutor to cover the compensation for state financial losses that have been charged to the convict.

The three land parcels executed by the prosecutor's office are in Mataram City.

First, the area of 124 square meters and the building above it are in the Pagutan area.

Then, the area of 68 square meters along with the building above it in the Dayan Peken area, and an area of 5,430 square meters along with the building above it in the Dasan Cermen area.

The Supreme Court through decision Number: 715 PK/Pid.Sus/2023 granted Aryanto Prametu's request for reconsideration and canceled the Supreme Court's cassation decision Number: 4168 K/Pid.Sus/2022 dated August 31, 2022.

The judicial review judge chaired by Suhadi with members Agustinus Purnomo Hadi and Suharto retrialed the case by declaring the convict Aryanto Prametu as the provider of seeds from PT Sinta Agro Mandiri (SAM) proven guilty of committing a criminal act of participating in corruption.

This is in accordance with the indictment of the public prosecutor with Article 2 paragraph (1) in conjunction with Article 18 of Law Number 31 of 1999 concerning the Eradication of Criminal Acts of Corruption as amended by Law Number 20 of 2001 in conjunction with Article 55 paragraph (1) of the 1st Criminal Code.

The judge sentenced him to four years in prison and a fine of Rp. 200 million, subsidiary to three months in prison.

The judge also imposed additional penalties on the convict to pay compensation for state financial losses worth Rp7.87 billion, subsidiary with the condition that if he does not pay within 1 month of the period since the decision has permanent legal force, Aryanto's property can be confiscated and auctioned off by the prosecutor to cover the replacement money.

In the event that the convict does not have sufficient assets to pay the replacement money, Aryanto must replace it by serving an additional sentence of one year in prison.

The decision, which has permanent legal force, has been submitted to the public prosecutors and convicts on November 10, 2023.
