Cancel The Decree Of The Affiliated Company For Online Gambling, Kemenkumham: Seen From The Goals Of Establishing Entities

JAKARTA - The Ministry of Law and Human Rights (Kemenkumham) takes firm action against companies affiliated with online gambling (judol) by canceling the decision letter (SK) for the establishment of the company.

The Director General of General Legal Administration (AHU) of the Ministry of Law and Human Rights, Cahyo Muzhar, said that these various steps were carried out since the beginning of the company registration in the AHU Directorate General (Ditjen) system in anticipation of illegal actions.

"This can be seen from the purpose of establishing an entity in the deed that will be made, from the start it will not be approved. But if at first there was nothing like that but in its implementation, illegal actions were taken, then of course action was taken," Cahyo said at a press conference in Jakarta, Thursday, August 15, confiscated by Antara.

He explained, when the company was first established, the entity would register with the Directorate General of AHU as a registered company to obtain a deed of establishment containing the purpose of establishing the company.

In addition, the company must also choose the Classification of the Indonesian Business Field Standard (KBLI) which will be included in the deed. The registration was carried out by a notary who was under the supervision of the Ministry of Law and Human Rights.

In making the deed, he said, the purpose of the establishment of a corporation should not be contrary to the law, so that the responsibility rests with the notary before ratifying the deed of establishment.

"So the notary is indeed the first sieveer as a GTeepers to prevent criminal acts," he said.

If the company that has received the deed of establishment on its journey is suddenly involved in illegal activities or businesses, such as online gambling, Cahyo emphasized that his party will first consult with law enforcement, the public, complaint services, and so on.

After that, he will block the company's access to the Legal Entity Administration System (SABH) and the Online Single Submission (OSS) system and report the company to law enforcement officials.

"If it has been blocked, the company is finished, it can't do anything else. We even cancel the decree unilaterally so that the company is disbanded," said Cahyo.
