Kasatpol PP Inactive South Jakarta Denies Committing Discipline Violations, Calls Problems Expired

JAKARTA - Head of South Jakarta's inactive Satpol PP Nanto Dwi Subekti spoke up regarding the Decree (SK) of the Head of the DKI Jakarta Satpol (Kasatpol) PP Number 54 of 2024 concerning Temporary Liberation from Position Tasks, which was given to him.

Later he said, the DKI Jakarta Kasatpol PP Decree Number 54 of 2024 was aimed at him, baseless, and even according to him was legally flawed.

"According to existing regulations, the alleged disciplinary violation case that I was accused of has expired," said Nanto Dwi Subekti, to reporters recently in Jakarta.

"Because this case occurred from 2016 to 2017, so I think this case is legally flawed," he continued.

Nanto explained that the alleged disciplinary violation in 2016 to 2017 began when he submitted his resignation letter as a civil servant when the Head of DKI Jakarta Satpol PP under Yani Wahyu Purwoko's leadership.

For two years, said Nanto, the application letter was not followed up by the then leadership of the DKI Jakarta Satpol PP.

"Because the application letter was not followed up, in 2018 I was active and returned to work with a decrease in structural positions as an expert level operational staff at the South Jakarta Satpol PP Trantibum Section," he said.

A year of active return to duty, in 2019 Nanto was entrusted with structural positions and rose to become a skilled level administrative staff in the South Jakarta Satpol PP's Peace and Public Order Section (Trantibum).

Shortly thereafter, in 2019 Nanto Dwi Subekti was promoted as Head of the Trantibum and Operation Section at the South Jakarta Satpol PP based on Decree Number 1633 of 2019 dated November 22, 2019 to 2023.

Then, on April 12, 2023, he was re-enhanced as Head of South Jakarta Satpol PP through Decree Number 266 of 2023.

However, on December 20, 2023, Nanto received a memorandum from the DKI Jakarta Provincial Kasatpol PP on suspicion of committing an act that violates the obligations and/or prohibits civil servants.

The official memorandum was followed by the issuance of the Decree of the Regional Secretary of the Special Capital Region of Jakarta Number 11 of 2024 concerning the Establishment of an Examination Team for Alleged Civil Servant Disciplinary Violations against Nanto.

Then, on March 8, 2024 Nanto Dwi Subekti received the first summons from the Head of DKI Jakarta Satpol PP to be examined in connection with alleged disciplinary violations in the form of not attending work without information that occurred from 2016 to 2019.

"Then on March 22, 2024 I got a decree that I was relieved of my duties as Head of South Jakarta Satpol PP," he said.

Reluctant To Violate Discipline

Nanto said that the DKI Jakarta Kasatpol PP Decree was related to the release of its duties for alleged disciplinary violations, as a rule, it had expired and was legally flawed.

This, he said, refers to the regulation of the State Civil Service Agency Number 6 of 2022 concerning the Implementation Regulation of Government Regulation Number 94 of 2021 concerning Employee Discipline as stated in Article 13 paragraph 1.

In the regulation, continued Nanto, it is explained that violations of the obligation to enter work and the provisions of working hours are calculated cumulatively until the end of the year or from January to December in the year concerned.

"So that the alleged disciplinary violation against me does not apply by law because the year has passed," he explained.

In addition, according to Nanto, with the issuance of the DKI Jakarta Governor Regulation Number 8 of 2024 concerning Employee Discipline, that the DKI Jakarta Governor Regulation Number 140 of 2011 has been declared invalid.

"Of course, it contradicts the Decree of the Regional Secretary of DKI Jakarta Number 11 of 2024 concerning the Establishment of this Problem-checking Team," he said.

"With the issuance of Pergub 8 of 2024, what is wrong with the DKI Regional Secretary for the inspection team?" said Nanto in surprise.
