JAKARTA - The Ministry of Law and Human Rights (Kemenkumham) confirmed the application for logo registration to be attached to the Indonesian Football National Team (Timnas) uniform by the Indonesian Football Association (PSSI) and Muhammad Sadad (Erspo) in accordance with legal provisions.
Director of Marks and Geographical Indications of the Directorate General of Intellectual Property (DJKI) of the Ministry of Law and Human Rights Kurniaman Telaumbanua said the application for logo registration (brand) submitted with the application number DID2024006041 in class 25 on December 19, 2023.
"Currently the application is still in the technical service stage and has not received legal protection because it has not been officially registered," said Kurniaman in an official statement received in Jakarta, Antara, Thursday, June 27.
He explained that brand registration applications do not automatically get legal protection even though they are listed in intellectual property databases. Legal protection is provided after the brand is registered and valid for 10 years from the date of receipt and can be extended.
Furthermore, he mentioned, in the application number DID2024006041, the applicant stated that he did not register the state symbol, but wanted to register a picture of the Indonesian national team uniform emblem containing the state symbol.
"The petitioner focuses on the shield image behind the national emblem," he said.
Kurniaman said Garuda's image as a state symbol (Garuda Pancasila Bird) cannot be registered and used without written approval from the authorities in accordance with Article 21 Paragraph (2) letter b of Law (UU) Number 20 of 2016 concerning Marks and Geographical Indications.
Thus, he said, the permit to use the state symbol for clothing items (jersei) can only be granted by the competent authorities.
"Devisions related to the use of state symbols are regulated in Law Number 24 of 2009 concerning the National Flag, Language and Emblem, as well as the National Anthem," Kurniaman added.
Previously, Jenama Mills, who had been an apparel producer for the Indonesian football national team from 2020 to 2024, said that the Garuda logo in the national team's jersey belonged to the Indonesian people.

According to Fajar, so far PSSI has not made any notification regarding the HAKI Garuda logo in the Mills product.
