KY Has Received The KPK Report On The Panel Of Judges Who Accepted The Exception Of The Gazalba Saleh Case

JAKARTA - Member and Spokesperson for the Judicial Commission (KY) Mukti Fajar Nur Dewata confirmed that his party had received a report from the Corruption Eradication Commission (KPK) regarding the panel of judges who granted the objection note (exception) of former Supreme Court Justice Gazalba Saleh (GS). "KY has received reports of alleged violations of the judge's code of ethics against the panel of judges in the case of a case of alleged gratification and money laundering that ensnared the inactive Supreme Court Justice GS. The report signed by the KPK chairman was addressed to the KY Chair," Mukti said when contacted from Jakarta, Antara, Wednesday, June 26. According to Mukti, the Chairman of KY Amzulian Rifai has given an assignment or position to the panel of judges (awaskim) to follow up on the report. "Currently, the Waskim team is preparing everything necessary to immediately follow up, including verifying the completeness of administrative requirements and the substance to be registered," he said. In addition, Mukti also said that KY prioritized the KPK report because it was given public attention. KY, he said, would process the report in accordance with applicable procedures, including digging for information, examining reporters, and witnesses. "In fact, it is possible that a summons will be made to the reported party," said Mukti. However, KY emphasized that it would not go to judicial technicalities because it was not under the authority of the institution. "KY will see if there is an ethical violation behind the decision. We will update the next information (renew)," added Mukti. Previously, KPK Chairman Nawawi Pomolango said that his party had reported the panel of judges who decided the interlocutory decision of Gazalba Saleh to KY and the Supreme Court (MA) Supervisory Body (Bawas). "We are no longer going to complain, we have complained," said Nawawi during a press conference at the KPK's Red and White Building, Jakarta, Tuesday (25/6). Nawawi explained that the report was regarding the alleged violation of the code of ethics of the judge who tried the Gazalba Saleh case. "Drafting rather than the report, one of which is that we see that the panel of judges at the first level in the product seems to direct our public prosecutors to follow the contents of the decisions they make. That's from the judge's aspect, we think it can be studied whether it violates a code of ethics or not," he said. The chairman of the KPK handed over to KY and Bawas MA regarding whether or not there was a violation of the code of ethics committed by the panel of judges. It is known that the panel of judges at the Corruption Court (Tipikor) at the Central Jakarta District Court, Monday (27/5), granted a note of objection or exception from the legal advisor team Gazalba Saleh. The panel of judges at the Corruption Court consisted of Fahzal Hendri as chairman, with Rianto Adam Pontoh and Sukartono as members. The corruption court ruled that the prosecution and indictment of the KPK public prosecutor could not be accepted, and ordered Gazalba Saleh to be immediately released from custody. Then, the Head of the KPK News Section, Ali Fikri, Wednesday (29/5), stated that the KPK prosecutor team filed a fight (verzet) against the interim decision. Then, Monday (24/6), the DKI Jakarta High Court decided to accept the request for an appeal against the KPK. The DKI Jakarta High Court canceled the decision of the Jakarta Corruption Court which granted Gazalba Saleh's objection note.

The high court also stated that the indictment in the name of Gazalba Saleh had met the formal and material requirements, as regulated in Article 143 paragraph (2) letter a and letter b of the Criminal Procedure Code. Therefore, the DKI Jakarta High Court ordered the Jakarta Corruption Court to continue the Gazalba Saleh case.
