Initial Session, Attorney Ngotot Rizieq Shihab Presented At The Court

JAKARTA - Attorney Habib Rizieq Shihab, Ramdhan Alamsyah objected because his client was not present directly at the East Jakarta Court. Instead, his client, Rizieq Shihab, underwent a virtual trial from Bareskrim Polri.

According to him, Rizieq Shihab should have been presented directly before the trial. The reason was the defendant did not crowd.

"The defendant alone is not complicated. Especially for the defendant, he should not be present, unless the witness can be from far away. The defendant must attend," said Alamsyah at the East Jakarta District Court, Tuesday, March 16.

According to him, the presence of the defendant in the trial was in accordance with the Criminal Procedure Code. "We object that the defendant should be present. The defendant was not present in the absensia case," he said.

This, he said, would be conveyed to the panel of judges to bring Rizieq Shihab to trial. "Later we will convey it at the trial," he said.

Confirming whether he could guarantee that there would be no crowds when Rizieq was presented, Alamsyah even said that there was a party responsible.

"That is a security function (if there is a crowd), the proof is that my car cannot enter," he said.

Previously, the National Police Public Relations Division Karo Penmas, Brigadier General Rusdi Hartono, said the trial was held virtually with Rizieq Shihab's position following the trial from Bareskrim.

"Even so, the Police are preparing troops for security at the East Jakarta District Court. There are about 658 personnel who will secure the MRS trial activities which will start tomorrow. Once again, in a virtual trial, the community must be understood, "said Brigadier General Rusdi.

To sympathizers or supporters of Rizieq Shihab, the National Police reminded that the trial was held virtual. The panel of judges who are at the East Jakarta District Court will conduct a teleconference with Rizieq Shihab at Bareskrim.

"This means that MRS will remain at the Bareskrim Polri to carry out the trial, it is better for whoever will attend the trial, do it according to the applicable regulations. Because the trial is virtual, activities will be conducted virtually too. So the people still follow that, so the MRS remains at the Police Criminal Investigation Unit, the activities are at the East Jakarta District Court, "said Brigadier General Rusdi.

For information, in the indictment, the Rizieq Shihab case registered Number 221 / Pid.B / 2021 / PN.Jkt. Team. Rizieq Shihab was charged with five articles of the indictment.

Among other things, the first Article 160 of the Criminal Code jo. Article 93 of Law of the Republic of Indonesia Number 6 of 2018 concerning Health Quarantine jo. Article 55 paragraph (1) 1st of the Criminal Code.

Or third, Article 93 of Law of the Republic of Indonesia Number 6 of 2018 concerning Health Quarantine jo. Article 55 paragraph (1) 1st of the Criminal Code.

Or the fourth Article 14 paragraph (1) of Law of the Republic of Indonesia Number 4 of 1984 concerning Outbreaks of Infectious Diseases jo. Article 55 paragraph (1) 1st of the Criminal Code

And the fifth Article 82A paragraph (1) jo. 59 paragraph (3) letters c and d Law of the Republic of Indonesia Number 16 of 2017 concerning Stipulation of Government Regulations in Lieu of Law Number 2 of 2017 concerning Amendments to Law Number 17 of 2013 concerning Community Organizations into Law jo.
