The South Jakarta District Court Judge rejected the pretrial lawsuit filed by MAKI, KEMAKI, and LP3HI against the Metro Jaya Police regarding the absence of former KPK chairman Firli Bahuri.
"The trial is in the exception, because the application cannot be accepted in the subject matter of the case. So the pretrial application cannot be accepted," said South Jakarta District Court (PN) Sole Judge Sri Rejeki Marshinta in Jakarta, Antara, Friday, April 5.
The judge in his consideration stated that the alleged bribery case committed by former KPK Chairman Firli Bahuri was still ongoing at the Polda Metro Jaya as evidenced by a number of evidences submitted during the trial.
In addition, the applicant also cannot prove that the case of the former Chairman of the Corruption Eradication Commission (KPK) has been stopped by investigators so that what was submitted (as a reason for the pretrial lawsuit) is still premature.
"There is no evidence whatsoever from the applicant in the termination, because the investigation is still ongoing, it cannot prove the argument," he said.
MAKI's attorney, KEMAKI and LP3HI, Rinaldi Putra, said that his party appreciated the judge's decision which rejected his lawsuit, because the point was not whether the lawsuit was accepted or not.
"This is still an early stage. We will conduct a pretrial again when one month from this decision is not also detained," he said.
The pretrial hearing at the South Jakarta District Court was submitted by the Indonesian Anti-Corruption Society (MAKI), the Indonesian Law Enforcement and Supervisory Agency (LP3HI) and the Community Harmony of Abdi Keadilan Indonesia (KEMAKI).
As the respondent, namely the Head of the Metro Jaya Regional Police, the Head of the Indonesian Police and the Head of the DKI Jakarta High Prosecutor's Office.
The three organizations filed a pretrial lawsuit against the Polda Metro Jaya at the South Jakarta District Court (Jaksel) regarding the absence of Firli Bahuri.
"Even though the determination of the suspect against Firli has been going on for a long time, which is more than three months," said MAKI Coordinator, Boyamin Saiman.
According to him, the lawsuit was filed against the respondent, one Metro Jaya Police Chief, two National Police Chiefs and three DKI Jakarta Prosecutors.
Boyamin said the main application was that the Kapolda and the National Police Chief had illegally terminated the investigation because they did not detain Firli Bahuri.
