PDIP Sues KPU To Administrative Court For Accepting Gibran's Candidacy To Become Prabowo's Vice Presidential Candidate

JAKARTA - PDI Perjuangan (PDIP) through the Indonesian Democratic Struggle Team (PDI) filed a lawsuit with the State Administrative Court (PTUN). The General Election Commission (KPU) became the defendant.

"The point of the lawsuit is an unlawful act by the state apparatus, the defendant KPU," said former Supreme Court Judge (MA) Gayus Lumbuun who became the leader of the PDI Team in the Administrative Court, Cakung, East Jakarta, Tuesday, April 2.

Gayus revealed that the act against the law committed by the KPU was to pass Gibran Rakabuming Raka as the vice presidential candidate accompanying Prabowo Subianto in the 2024 presidential election. This institution is considered to have violated the law because it contradicts the principles and norms in the general election (election).

Complementing Gayus' statement, Erna Ratnaningsih, a member of the PDI team said that the KPU still used the old rules when it received Gibran's candidacy. This step is considered to have violated the law because it has not been adjusted to the decision of the Constitutional Court (MK) number 90/PUU-XXI/2023 which amended Article 169 letter q of the Election Law.

The KPU only issued PKPU Number 23 of 2023 on November 3 or a week after receiving Gibran's registration. "In this case, when the KPU received registration, the KPU still used the old regulations, PKPU Number 19 of 2023," he said.

"This means that the KPU's actions violate legal provisions, violate legal certainty where he enforces applicable regulations," Erna continued.

The PDI team believes that the KPU's actions are legally flawed when implementing the registration reception mechanism. So there are four things that are requested in the lawsuit against the KPU.

The first is to postpone the implementation of KPU's decision Number 360 of 2024 concerning the Determination of the Results of the Presidential and Vice Presidential Elections, members of the DPR, DPRD, DPD, and so on.

Then the PDI team asked the Administrative Court to order the defendant not to issue or take administrative action until a decision with permanent legal force.

"In the main petition, we ask that the panel of judges will later accept and grant the plaintiff's claim in its entirety. To declare null and void Number 360 decision, KPU Decree Number 360 of 2024 and so on," said Erna.

"Ordered the defendant to revoke KPU's decision number 360 of 2024 and so on and the last is to order the defendant to take action, revoke and cross out the Prabowo presidential candidate pair and Gibran vice presidential candidate as stated in KPU's decision number 360 of 2024," he concluded.
