JAKARTA - The Constitutional Court (MK) received the application of Amicus Curiae or Friends of the Court for the panel of judges who tried the 2024 Presidential Election Result Dispute (PHPU) case from the academic alliance and civil society on Thursday (28/3).

Reported by ANTARA, Friday, March 29, acting as the party receiving the proposal was the Head of the Community Relations and Protocol Bureau of the Constitutional Court Budi Wijayanto and the Head of the Public Relations and Domestic Cooperation Section of Andi Hakim.

Budi said that his party would convey Amicus Curiaeini to the Chief Justice of the Constitutional Court Suhartoyo and other judges. He also appreciated the attention conveyed by the academic alliance and civil society.

As many as 303 people from academics and civil society have applied to be Amicus Curiae. Perumusus Team Amicus Curiae consists of Lecturer at the Faculty of Law, Atma Jaya University, Yogyakarta Benediktus Hestu Cipto Handoyo, Lecturer at the Faculty of Law, Gadjah Mada University (UGM) Dian Agung Wicaksono, UGM Faculty of Law Lecturer Marcus Priyo Gunarto, Lecturer at the Faculty of Law, University of Indonesia Sulistyowati Irianto, and UGM Faculty of Law, Rimawan Pradiptyo.

The submission file Amicus Curiaedi was submitted by representatives of the Alliance of Academics and Civil Society, namely a socio-political observer from the Jakarta State University Ubedilah Badrun and Professor of Law Anthropology at the Faculty of Law, University of Indonesia, Sulistyowati Irianto.

Ubedillah said, basically there were nine files for nine judges, but his party asked Amicus Curiae to only be given to eight Constitutional Justices because one judge was not allowed to participate in the PHPU case, namely Anwar Usman.

"NaskahAmicusini is an important part of public participation, from scholars, professors, academics, including the 303 civil society. We discussed very long to provide considerations with a scientific basis," he said.

The hope of Amicus Curiaeini's submission, he continued, is that the PHPU presidential election case, which is currently being tried, can be decided fairly.

"It is decided fairly, so it is not in the sense of being scored. It can be decided fairly that the consequences can be won, it can be given special considerations," he said.

The same thing was also conveyed by Sulistyowati Irianto. He hopes that the Constitutional Court can provide substantive justice in handling the PHPU case for the presidential election.

"We really hope that the judges of the Constitutional Court will not only provide only formal procedural justice or just fair numbers, but also provide substantive justice. So, looking at cases holistically, seeing all processes because the results depend on the process," he said.
