JAKARTA - Spokesperson for the Constitutional Court (MK), Fajar Laksono, ensured that constitutional judge Anwar Usman could still handle the dispute over the results of the general election (PHPU) for the 2024 Legislative Election (Pileg).

Anwar Usman, said Fajar, will participate in one of the panel of constitutional judges to examine, try, and decide on disputes over the results of the 2024 Legislative Election.

Anwar Usman's involvement in handling disputes over the results of the 2024 General Election is tied to the decision of the Honorary Council of the Constitutional Court (MKMK). In the Constitutional Court's decision, said Fajar, Anwar Usman was allowed to handle the dispute over the results of the legislative elections with a note.

"If it's a legislative election with a note. As long as there is a conflict of interest, it's not allowed," Fajar said in his statement, Friday, March 23.

However, Fajar said, Anwar Usman could not participate in examining, adjudicating, and deciding on the dispute over the results of the 2024 presidential election. The prohibition is also stated in the Constitutional Court's decision.

"If the presidential election is in accordance with the Constitutional Court's decision, yes. It is not permissible to be involved, indeed Anwar Usman in the Constitutional Court's decision and the Constitutional Court obeys the decision," said Fajar.

It is known that the Constitutional Court's decision registered with Number 2/MKMK/L/11/2023, has prohibited Anwar Usman from being involved or involved in examination and decision making in disputes over the results of the presidential and vice presidential elections, election of members of the DPR, DPD, and DPRD, as well as the election for governors of regents and mayors who have the potential for a conflict of interest.

This prohibition is because Anwar Usman was proven to have committed a serious ethical violation. In addition, Anwar Usman was also sanctioned for being dismissed from the position of chairman of the Constitutional Court. Including, Anwar Usman has no right to nominate himself or be nominated as the leader of the Constitutional Court until his term as a constitutional judge ends.
