5 Cases At The North Sumatra Prosecutor's Office Processed Restorative Justice, Including Curi Sawit At Plantations

NORTH Sumatra (North Sumatra) High Prosecutor's Office (Kejati) has stopped prosecuting five cases with a restorative justice (RJ) approach because the litigants have reconciled.

"The cases approved from Jampidum are Simalungun District Attorney (Kejari) Serdang Bedagai, Tebing Tinggi, Langkat Kejari and Asahan Kejari," said Head of Legal Information Section Yos A Tarigan in Medan, confiscated Friday 15 December

He detailed that the Simalungun Prosecutor's Office and the suspect Christina NY Siregar violated Article 480 paragraph (1) of the Criminal Code, then the Serdang Bedagai Prosecutor's Office and the suspect Nadia Andjelita violated Article 480 paragraph (1) of the Criminal Code.

Furthermore, the High Cliff Prosecutor's Office with the suspect Roy Rogerst Raja Guk Guk alias Roy violated Article 363 paragraph (1) 3, 4 and 5 of the Criminal Code.

In addition, from the Langkat Kejari with the suspect Josua Septian Siboro alias Josua violated Article 111 subsidiary Article 107 letter d of the Republic of Indonesia Law No. 39 of 2014 concerning plantations in conjunction with Article 55 of the 1st Criminal Code or Article 363 Paragraph (1) of the 4th Criminal Code.

Next, from the Asahan Kejari with the suspect Renaldy violated Article 107 letter d of Law No. 39 of 2014 concerning Plantation in conjunction with Article 55 of the Criminal Code, the two suspects committed theft of the plantation's palm oil head.

"The prosecution with a restorative justice approach is based on the consideration that the suspect has committed a criminal act for the first time, the losses incurred are no more than Rp. 2.5 million with a penalty of no more than five years in prison," said Yos.

The peace process between the suspect and the victim was witnessed directly by the families of both parties, community leaders, investigators from the police and the general prosecutor.

"This peace also opens up a legal space to return the situation to its original state, there will be no more grudges in the future, and the suspect promises not to repeat his actions," he said.
