Defendant Of Destruction Of Arema FC Office Sentenced To 9 Months In Prison

Eight defendants vandalized Arema FC office located on Jalan Mayjend Panjaitan Number 42, Klojen District, on January 29, 2023, were sentenced to nine months in prison.

The panel of judges at the Malang District Court led by Judge Arief Karyadi said the defendants were legally and convincingly proven to have violated the articles imposed on the defendants.

"Because it has been legally and convincingly proven, as many as eight defendants were sentenced to nine months in prison," said Arief as quoted by ANTARA, Wednesday, October 11.

During the trial, as many as seven defendants, namely Feri Kriddianto, Aron Cahya, Nouval Maulana, Cholid Aulia, Adam Rizky Satria, Muhammad Fauzi and Andika Bagus Setiawan were found guilty of violating Article 170 paragraph (1) of the Criminal Code regarding jointly committing violence against people or goods.

Meanwhile, the defendant Fanda Harianto alias Ambon Fanda was found guilty of violating Article 160 of the Criminal Code concerning incitement so as to threaten security, peace, welfare and public order.

In the trial which was followed by the defendants online, Arief explained, the sentence for nine months would be reduced by a period of detention. The defendants have served eight months and 15 days of detention.

"So (the defendant) only has to serve a sentence of 15 days, after that he is free," he said.

According to him, there were a number of things that made the defendant get a nine-month sentence, namely the defendant's actions were detrimental to Arema FC management. Meanwhile, the mitigating factor is that the defendant is cooperative.

"As for mitigating matters, the defendant is cooperative and his actions have been forgiven by the management of Arema FC," he said.

Meanwhile, the legal adviser for the defendant Feri Krisdianto and five other defendants, Fariz Aldiano Modal, expressed his thoughts on the judge's decision. His party will take further legal action.

"We will take legal action, but we are still thinking about it," he said.

The legal adviser to the defendant Fanda Harianto, Adhy Darmawan, expressed disappointment with the judge's decision and would think about it. The verdict was deemed unfair, because the witnesses said that the defendant Fanda did not direct the destruction of Arema FC's office.

"In our opinion, the decision was unfair. Because in the trial, the witnesses did not say that Ambon Fanda had deployed destruction at the Arema FC office," he said.

On January 29, 2023, the demonstration initiated by the Arek Malang group Act at 11.30 WIB ended in chaos. The Arema FC office on Jalan Mayjend Panjaitan Number 42, Klojen District, Malang City was damaged.
