Bawaslu Finds Problems When Handling ASN Netrality Violations

JAKARTA - The Coordinator of the Puadi General Election Supervisory Division for Handling Violations, Data and Information, said that his institution was facing various issues related to legal technicality and meaning in dealing with violations of the neutrality of the state civil apparatus (ASN).

"The ASN problem is extraordinary. In the 2020 Pilkada, there were 1,536 alleged violations, while the number of cases that were terminated was 53 and those recommended (to be followed up) there were 1,398," Puadi said when receiving an audience of the State Administration Agency (LAN) in Jakarta as reported by ANTARA, Tuesday, October 10.

Puadi said there were differences in handling violations of ASN neutrality in Law number 17 of 2017 concerning Elections, Law number 10 of 2016 concerning Pilkada, and Law number 5 of 2014 concerning ASN.

He said that in the ASN Law, violations of ASN neutrality were only subject to administrative sanctions. Meanwhile, according to him, in the Election Law and the Pilkada Law, there are two types of sanctions, namely administration and crime.

In addition, according to Puadi, the number of Bawaslu recommendations related to violations of ASN neutrality with unclear handling status is also a separate problem.

"There is also a recommendation from KASN (State Civil Apparatus Commission) that the PPK (Employment Officer) does not follow up. This is a crucial note," he said.

Bawaslu will intensify the socialization of regulations related to the guidelines for fostering and supervising ASN neutrality in elections due to high violations of neutrality.

Based on KASN data in 2022, 2,073 civil servants were reported for alleged violations of neutrality. A total of 1,605 people or 77.5 percent of the number of ASN reportedly proven to have committed violations and received recommendations for KASN to be sanctioned.

Meanwhile, 88.5 percent of the number of ASN proven to have violated or a total of 1,420 people had been followed up on their cases and received moral and disciplinary sanctions from the Personnel Guidance Officer (PPK).
