The panel of judges at the Bandung District Court, Bandung City, West Java sentenced the inactive Supreme Court Judge Sudrajad Dimyati to eight years in prison as a defendant in the bribery case in the Supreme Court.
Chief Judge Yoserizal said Sudrajad was legally and convincingly proven to have committed a criminal act of corruption together. According to the judge, Sudrajad received a bribe of 80 thousand Singapore dollars in that case.
"The defendant was sentenced to eight years in prison and a fine of Rp. 1 billion, provided that if the fine was not paid, it would be replaced with imprisonment for three months," said Yoserizal at the Bandung District Court, Antara, Tuesday, May 31.
The judge said that Sudrajad was proven guilty in accordance with Article 12 letter c in conjunction with Article 18 of the Law of the Republic of Indonesia Number 31 of 1999 as amended by Law of the Republic of Indonesia Number 20 of 2001 concerning Amendments to Law of the Republic of Indonesia Number 31 of 1999 concerning Eradication of Criminal Acts of Corruption in conjunction with Article 55 paragraph (1) of the 1st Criminal Code.
In his decision, the judge said that the aggravating punishment for Sudrajad was not supporting the government's program in efforts to eradicate corruption and undermine public trust in the Supreme Court institution. Then the judge also believed that Sudrajad enjoyed the bribes.
Meanwhile, mitigating factors, said the judge, Sudrajad was polite during the trial, had family responsibilities, and had never been convicted before.
The judge believes that Sudrajad has received the bribe from Elly Tri Pangestuti as ASN at the Supreme Court.
Elly is one of the intermediaries in the flow of bribes from Heryanto Tanaka who wants the Supreme Court to examine and try case Number 874 KPDt.Sus-Pailit/2022 so that the case is granted.
Meanwhile, member judge Benny Eko said that Sudrajad and Elly did not have a relationship that was not harmonious, so the judge believed that giving the money was not to plunge Sudrajad.
"The panel of judges believes the defendant has received 80 thousand Singapore dollars," said Benny.
The verdict of the panel of judges was lower than the demands of the Public Prosecutor (JPU) who previously demanded that Sudrajad Dimyati be sentenced to 13 years in prison and a fine of Rp. 1 billion.
In addition, the prosecutor also demanded that Sudrajad pay compensation of 80 thousand Singapore dollars in accordance with the bribe received.
