As A Suspect In The Hate Speech Case, Bahar Smith Is Detained At The West Java Police Detention Center

BANDUNG - The Head of Public Relations of the West Java Police, Grand Commissioner Ibrahim Tompo, confirmed that Bahar Smith (BS) has been detained at the West Java Police Detention Center, after being named a suspect in a case of spreading false news or hoaxes.

He said Bahar Smith had been detained since Monday, January 3 night after being questioned until 21.00 western Indonesia time. Bahar was named a suspect after investigators obtained two pieces of evidence in the case of spreading the hoax.

"Yes, so BS is being held at the Detention Center of West Java Police, now he is in a cell," he said, in Bandung, as reported by Antara, Tuesday, January 4.

As for before the detention process, according to him, Bahar Smith had a health check, including an antigen test.

"Indeed, it begins with a health check. From a health examination, his condition is quite healthy," he said.

During his detention, according to him, in the future, he will undergo an examination to complete the investigation after the police have conducted a case.

"There are still a series of completeness of information and administrative completeness of the investigation that must be completed, and must be examined for additional information," he said.

In the determination of the suspect, Bahar Smith was charged with Article 14 Paragraph 1 and 2 of Law Number 1 of 1946 concerning the Criminal Law Regulation in conjunction with Article 55 of the Criminal Code, and or Article 15 of Law Number 1 of 1946 concerning the Criminal Law Regulation in conjunction with Article 55 of the Criminal Code, and or Article 28 Paragraph 2 in conjunction with Article 45a of the ITE Law in conjunction with Article 55 of the Criminal Code.

He said the legal process against Bahar Smith began with the Police Report Number B 6354/12/2021 SPKT PMJ 2021.

Bahar Smith was reported by someone with the initials TNA due to an alleged spread of false information while giving a lecture in Margaasih District, Bandung Regency, West Java, on December 11, 2021.
