JAKARTA - Minister of Manpower Ida Fauziyah revealed that to date, no employer has reported his inability to pay the 2021 religious holiday allowance (THR) for his workers in full.

As is known, last week the Ministry of Manpower issued a Circular (SE) number N / 6 / HK.04 / IV / 2021 concerning the Implementation of Religious THR Granting in 2021 for Workers / Laborers in Companies. This Circular Letter stipulates that employers are required to pay their employees' THR in full or not in installments no later than H-7 before this year's Eid.

However, the government provides concessions for entrepreneurs who are unable to pay the THR in full due to the impact of businesses that have not recovered due to COVID-19. Employers can report the condition of their company to the local Manpower Office.

"To this day, there are no companies that cannot afford it. Because complaints usually read in the second and third weeks and the deadline for paying the THR H-7. So employers or workers report on D-7," he said in a virtual press conference, Monday, 19 April.

Before reporting to the Ministry of Manpower, said Ida, entrepreneurs who are unable to pay the THR in full this year must have a dialogue first with their workers, including as a family.

"The dialogue between employers and workers regarding disability is based on evidence of internal financial reports and the results of bipartite discussions. Reported at the local manpower office," he said.

Furthermore, Ida said, entrepreneurs who violate by not giving THR in full and on time in accordance with statutory regulations will receive administrative sanctions and fines.

The rules regarding sanctions are regulated in the Minister of Manpower Regulation (Permenaker) Number 6 of 2016 concerning Religious Holiday Allowances for Workers or Laborers in Companies. In this regulation, companies that are late in paying Religious THR are subject to a fine of 5 percent.

"Sanctions for late payment in accordance with statutory regulations will be subject to fines. These fines are used for the benefit of workers or laborers," he explained.

Therefore, Ida asked all related parties to support the implementation of the 2021 Religious THR payment. Including in this case the leaders in the regions. He hopes that this rule can satisfy both parties, namely workers and employers.

"I ask the active role of the governor, regent, mayor to supervise and impose sanctions on entrepreneurs who violate the implementation of THR 2021 in accordance with the applicable laws," he said.
