Three Defendants Of Hazardous Cosmetics Immediately Tried At The Makassar District Court

The three defendants in the case of ownership and circulation of beauty cosmetics containing dangerous materials immediately underwent their first trial after the file was declared complete or P21 by the Public Prosecutor (JPU) next week at the Makassar Class I District Court, South Sulawesi.

"The schedule for the inaugural trial is for the three defendants, the defendants Agus Salim and Mira Hayati on Tuesday, February 25 and for the defendant Mustadir Dg Sila on Wednesday, February 26, 2025 at the Makassar District Court," said Kasi Penkum of the South Sulawesi High Prosecutor's Office Soetarmi in Makassar, Wednesday, February 19.

The trial schedule was known after the Public Prosecutor's Office of South Sulawesi and the Makassar Kejari handed over three defendants and evidence in cases of skincare or cosmetic beauty containing mercury or dangerous, to the District Court for further trial.

Previously, investigators from the South Sulawesi Regional Police transferred the case files of the three suspected dangerous cosmetics to the Prosecutor's Office for further processing to the court stage with the status of a defendant.

The defendant Agus Salim (40) is the owner of the Ratu Glow brand and King Glow who circulated the RG Raja Glow My Body Slim subscription after being tested at BPOM Makassar and did not meet the distribution requirements.

The reason is because it contains Bickodil (positive) which is a raw material for drugs (BKO) that should not be contained in traditional or herbal medicinal ingredients.

The defendant's actions have produced or circulated pharmaceutical preparations and or medical devices that do not meet the standards and/or requirements of safety, efficacy and quality.

The defendant was charged with violating Article 435 in conjunction with Article 138 paragraph (2) of the Republic of Indonesia Law on Omor 17 of 2023 concerning Health with a maximum imprisonment of 12 years or a maximum fine of IDR 5 billion.

Furthermore, the defendant Mustadir Daeng Sila (42) as Director of CV Fenny Frans who produced and circulated FF Day Cream Glowing cosmetics and FF Night Cream Glowing after being tested by BPOM Makassar was positive for mercury or Raksa or Hg.

The defendant's actions in producing or distributing pharmaceutical preparations and / or medical devices that do not meet standards and / or requirements for safety, efficacy / benefit and quality.

The defendant was charged with violating the provisions of Article 435 in conjunction with Article 138 paragraph (2) of the Republic of Indonesia Law number 17 of 2023 concerning Health and threatened with a maximum imprisonment of 12 years or a maximum fine of IDR 5 billion.

In addition, the defendant has produced and/or traded goods and/or services that do not meet or do not comply with the required standards and provisions of the legislation.

The suspect also violated Article 62 paragraph (1) in conjunction with Article 8 paragraph (1) letter a of Law No. 8 of 1999 concerning Consumer Protection with a maximum imprisonment of 5 years or a maximum fine of IDR 2 billion.

Meanwhile, the defendant Mira Hayati (29) is the President Director of Agus Mira Mandiri Utama who produces/distributes Lightening cosmetics Skin Mira Hayati Cosmetic and MH Cosmetic Night Cream Glowing after being tested by BPOM Makassar positively containing mercury or Raksa or Hg.

The actions of the defendant Mira Hayati in producing or distributing pharmaceutical preparations and or medical devices that do not meet the standards and/or requirements of safety, efficacy or benefit and quality.

The defendant was charged with violating Article 435 in conjunction with Article 138 Paragraph (2) of Law U RI Number 17 of 2023 concerning Health with a maximum imprisonment of 12 years or a maximum fine of IDR 5 billion.
